I am just about to start the whole DCF process in London, however I wanted to get all my paperwork together first.

I have a question regarding taxes. I filed my taxes for 2007, but haven't done it for 2008 yet - Do I really need to have 3 years tax returns to submit with the I-864? Also How can I show proof that I filed for 2007? I (stupidly) didn't make any copies of my forms. Should I just request a transcript?

I am sorry if this is really vague or just plain stupid sounding. I am confused and realise that the deadline for filing is creeping up quickly. Any advice would be appreciated. Thank you!

A sponsor is required to submit an IRS transcript or photocopy of only the most recent Federal income tax return.

However, submitting tax returns for the three most recent years is highly recommended.

You need to request a transcript for 2007 if it is the most recent one you have filed.

BTW, the deadline of 2008 tax return for USC residing oversea is upcoming.

I recommend you to file it now, make copies and attach one to your I-864.

For 2007 request a transcript. It is automatically mailed to the last address you used on your most recent tax filing. Do you have someone in the US who can forward it to you? Otherwise, you may want to take the extra time and speak to an IRS rep and ask if they can mail it to you in the UK. For 2007 did you use a company to file your taxes, you should be able to call them and get them to copy and mail your taxes.

For 2008, include a copy the forms where you applied for an extension.

Correction you may provide up to 3 years of federal tax filings for the I-864 to establish your ability to maintain adequate income. Read the instructions section 25. Only 1 year is required, but many people send 3, in hopes of preventing a RFE.

Since it is 2009 now, you will have to show 2008 taxes, as they are the most recent tax year.

There are some posts here where they RFE for the 2008 returns, since the person applied for the application in 2009.

Or - you will have to explain why you haven't filed yet.

either way, you should include 3 years worth of tax transcripts, it doesn't cost anything to get them from the IRS.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You will need to file your 2008 return.

From the I-864 Instructions:

If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support. If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation. If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it. Residence outside of the United States does not exempt U.S. citizens or lawful permanent residents from filing a U.S. Federal income tax return. See "Filing Requirements" in the IRS Form 1040 Filing Instructions to determine whether you were required to file.

In my case I put the number/amount from the joint return. That number included my ex-wife's income. Wasn't an issue for us.
