abandoning K-1, going for B2 (crazy we know!)

As others have mentioned, you may have problems getting the B2. Since you and your SO have decided to remain in Sri Lanka, perhaps you can get married there and the US citizen can apply for Sri Lankan residency. This and other evidence may showing that you and the US are tied to Sri Lanka and that you just want to visit the US and not get married may help with the B2. Not sure how long it would take, but it might be a decent plan B.

So unless you lie, (which is not recommended), they will know a K-1 was initiated.

They file for a immigrant visa (k-1)

The K-1 Visa is not an immigrant visa.

but the K-1 is a non immigrant visa, is it not? so i wrote "no."

the interview is next week, i am more than happy to write a new DS-156 and a new #36 on if i messed it up. i was under the impression that since K-1 is non-immigrant, that #36 would be "no."

obviously we're in "full disclosure" mode, no lies here.

January 4th, 2008 we met on holiday in sri lanka

February 21, 2008 madu moved to Cambodia to live with me

October 3, 2008 our daughter was born in Thailand

Nov 14, 2008 sent I-129F to CSC

Nov 21, 2008 check cashed

Dec 3, 2008 NOA1 received

March 9, 2009 APPROVED!

March 19, 2009 sent to Embassy

Yup. The Department of State webpage on the K-1 is titled "Nonimmigrant Visa for a Fiance(e) (K-1)."

I would have gone with the K1 as well, and taken the 90 days in the US.

I hope that you won't have any problems to get the B2 though! Good luck!

we got it-- he had a binder full of proof and the CO didnt ask to see a thing. we are over the moon! thanks to all on here for your support.

01/14/2009 -- she flies to USA, stuck overnight in Frankfurt

01/15/2009 -- she arrives in USA

01/16/2009 -- proposed! she says YES!!! :)

02/14/2009 -- 6 days of bliss in Walt Disney World (6mo given on I94)

02/23/2009 -- sent I129F Next Day Air

02/25/2009 -- NOA1

03/01/2009 -- Touched

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)

Congratulations for getting your B2! I think CO's in most situations will understand that life changes happen, and as long as you are clear and have good supporting evidence showing why things have changed and what you know intend to do, it can be done! You seem frank and responsible, so I'm sure this was noted at the interview.

I don't think you're out of your mind for switching to a B2 when your circumstance changed, after all, he was no longer intending to reside in the US after the wedding, which is the point of the K1. We had a similar situation and ended up going for K1 but it meant making difficult choices about jobs, where we would live, etc. and given how lengthy and stressful that process was we kind of wished we had gone for the B2 instead to bring him to the states for the wedding and go back abroad afterwards...but, that's life, and hopefully things work out ok with our K1!
