Ok. On your previous post, you said your GC expires 8/20/09. So if you count back 90 days on the calender, the earliest possible receipt date for them to accept your petition is 5/23/09. 20 days in August, 31 days in July, 30 days in June, count back 9 more days in May (31, 30, 29, 28, 27, 26, 25, 24, 23), that's how I get when your 90 days window started. I understand your frustration, I'm not saying they're entirely correct either because they told you to send after 5/20/09, but the correct date is supposed to be 5/23/09, so I understand your frustration and hope they'll accept your package with no problem this time. Yeah now that I calculate in your way I think you are right and more if what TayRivers wrote is correct that they use the date it was mailed, this is a very important tip to use for the future filers.

The other thing that I was going to comment is that looks like my package was just going to be processed when they realize the date because even the check had a Stamp in the back of the Bank of America "to only deposit this check in the account..." And the first page of the I-751 form had a red stamp with some numbers and letters. Also they put the acco fasteners in the whole package with a hard piece of "cardboard" in the back to hold everything. I left everything that way. I think I will save some time to the new officer that receive my package and is the way they like.

I am also 1000000% sure that they received other applications in the same situation (like me) with no problem but they was very very very strict with the 90 day rule in my case. Bad luck for me this time.

I hope everything will be smoth now with my case and with those waiting for a positive result on their cases.

I think they would count the date that they open the package. It's what I think by logic, might not be true, but here is another jasminelily's alien theory. According to my case, I mailed USPS express mail on 1/28/09, USPS tracking said the package arrived there 1/29/09, but my receipt date is on 1/30/09. I would think that they process lots of packages in a day, and sometimes if the packages arrive in the afternoon, they won't be able to process them on the same date, so they wait till the next day. So I would say sometimes if they work a little slowly, it might be your luck if you mis-calculated and it arrived a day early and if they're too busy to open your package, and they wait till the next day, then boom! you met the requirement, you're not a day too early anymore. So I think they count by receipt date (the date that they open and process your package). It's just a theory.

Ok guys I am back from the post office... I was right :-( My application was returned for the absurd reason that was filed too early... And is ABSURD because the letter explaing why my application was returned said that I need to re-send the I-751 AFTER 05/20 and They received my application on 05/21!!! There is stamps all over the pages with that date so I am pretty sure that the officer didn't want to work that day and the easy way to avoid an application is to return it...

Even more is crazy for the money lost (they paid $9.65 to return my package, plus what I paid in first place and what I paid today).

Anyway... I ate my frustation but I was prepared going to the post office with a new cover letter and a new check (both with updated dates) so I did a quick check of all the documents in the package to see if they remove something, replaced the cover letter and the check and re-send the whole package again hoping this time the officer that receive my package is in good mood and start my application promptly...

Hugo Chavez doesn't have to approve the application, does he??! :star: :star:

Hello guys,

Today I received in the mail a Notice from USPS trying to deliver a large envelope. I am not expecting anything from anybody except from USCIS.

Two more tips why I think is the I-751 returned:

1) The USPS notice show my second last name that I NEVER use in US since is very confusing to everybody to understand that in my country we have 2 last names so I only use one except for any process with USCIS or Social Security but not even with the banks...

2) The USPS notice show that is a "Large envelope" so if is a NOA should come in a letter envelope or something small not in a "Large envelope" I think.

I am a little bit worried because I double check everything before send the package: Dates, signatures, check (, name in pay to the order of OK, amount OK and with 00/100). My GC expires in 08/20 and they received the package on 08/21 so that is OK too!

Obviously I will go to the post office as soon as they open tomorrow morning! I hope will be something else but I am pretty sure is USCIS related...

I will let you know guys tomorrow morning.

Hello there. I see that they returned your I-751. I received a rejection letter today because I filed too early. It's 4 days early... anyway, do you think they will return my whole package including the money order?

05/08/2010 - Officially engaged!! ( He sent the engagement ring 09/24/2010 and he proposed to me on bended knee in Philippines with the second part of engagement ring) *melting*

06/18/2010 - I-129F package Sent

06/21/2010 - NOA1

06/24/2010 - Touched

09/23/2010 - Touched (when I contacted the Congressman's office)

11/15/2010 - Touched (hopefully the approval)

11/17/2010 - NOA2 (Received hard copy 11/22/2010)

12/01/2010 - Received a letter from DOS dated 11/29/2010 stating that the petition will be forwared to USE AD within a week and that I will received the packets very soon from embassy.

01/18/2011 - Interview. APPROVED!!! No words can express how happy i am.

01/25/2011 - VISA in hand! YAY!!!

02/20/2011 - POE Chicago (O'hare)

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
