My boyfriend and I met online in January 2009 and have fallen in love with each other madly. I live in the Netherlands and he is in Seattle. HE cannot move away from America because of his son, hence I will have to move. We want to get married and do not mind doing the K-1or even the K-3 if necessary. It is nearly June now and we would like for me to be there by December 2009. What is the fastest way for me to get there? The options I am thinking of are :

1. Go there as a visitor, get married and file for K-3? ( I am aware this might qualify as Visa Fraud but correct me if I am wrong and share your experiences if you have any);

2. Apply for a K-1 visa as soon as possible, will this be processed in 5 months?

3. Get married here in The Netherlands and apply for K-3 is this faster than the K-1 ?

4. What is a CR-1? is that the same as K-3?

WE would appreciate any help so that we can start our beautiful life together soon :)

december 2009 is very optimistic in any scenario....

K-1 is fastest typically because you can file today (assuming all requirements are met) versus a spouse visa which requires a marriage to have occured and that cannot happen today....

K1's usually go faster than a K3/CR1. Also, since you just met, I think doing the K1 would be the better option because then you have the option of changing your mind in case it doesn't work out between now and then. I think K1 is your best option. Lately K3 is not any quicker than the CR1 and it just causes more paperwork and headache, so if you get married first, don't bother with the K3 unless you have other reasons use it. Read the guides and they will explain everything. :-)

i don't think you would file a K3 in that case, you would just file to adjust your status

and yes it can be construed as visa fraud

the K1 is probably your best bet

Thank you everyone, I guess we will start reading up and get ready for K-1 in this case. Seems like that is the most legit and fast way from all the postings I have read so far. Anyone managed to get their K-1 in 6 months or less?

many, but you must consider the current state of the USCIS processing timelines and how fast your local consulate is on scheduling interviews... it speeds up and slows down all the time.... it has been slow and recently picked up speed (at least for California) but that could change overnight.

i don't think you would file a K3 in that case, you would just file to adjust your status

and yes it can be construed as visa fraud

the K1 is probably your best bet

Staying and adjusting status would be visa fraud but leaving without an overstay while pursuing a spouse visa is not visa fraud. Getting married on a tourist visa is legal. Intending to immigrate (stay) after entering on a tourist visa is not legal.

You didn't mention if you both have actually met in person. If you haven't physically met each other within the past two years then you can't file for the K1. There are exceptions to this rule, but they are very rarely ever granted.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
