Okay VJer's,

Many know my cases, many know I was married via proxy and went to Paris that evening of our marriage, arrived the next day in France , husband was alrady there, he holds a French Residency card.

We sent evidence of our honeymoon, plus the 3 years together, a MOUND of evidence, maybe too much. And they did not bother to look closely for honeymoon evidence.

May 16th got RFE in mail, asking for consummation proof. So I re-sent the pics of us holding 2 different dated newspapers and copies of the newspapers "Colored copies" plus our back to back ATM card transactions, with copies of his ATM card and mine to show our partial ATM card numbers on the receipts so USCIS can match them up, along with details of each transaction to show we were together same place, same time for honeymoon. More then enough to see we were together for honeymoon, also my airline info., boarding passes, my passport and also his passport to show he neither left or enter France during our honeymoon,and his French residency card to show he did not have to travel for honeymoon.

All evidence is dated on our honeymoon dates, Feb. 11th to Feb. 16th. And all dated BEFORE USCIS received our petition March 6th, 2009. and we have not been together since, so they cant say we created evidence.

Now my question is, I did a Notarized Affadavit stating we were together for honeymoon, consummated & etc. etc. My husband also did one but his was NOT notarized, due to he could not get a appointment with U.S. Embassy in Paris till June 8th, and our deadline to submit RFE evidence was June 11th.

So do Notarized Affadavit hold any weight with USCIS????

Yes they do, form I-130's directions indicates affidavits from friends or family.

NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage);

Thank you, but do they hold their weight when done by petitioner or beneficiary?

Now a friend of mine who attended the ceremony wrote one in my behalf, but of course she was not there in France for hneymoon. Only me and him, we did not go out with friends or family, too cold, and honestly, we wanted to be alone. Maybe our down fall. I do know my affadavit can be used against me if Im lying, which Im not, I have nothing to hide nor does my husband.

can any family attest that you went to france? i wish you could've included some from friends and family.

however, the one from your hubby might get overlooked... you did send tons of evidences... or they will just ask for more evidences.

i think the most important evidences are the passport stamps and boarding passes... pictures can be retouched nowadays, so i don't think they really hold much weight. Receipts are good too. It would've been good if you went out with some friends while in France, but that's moot now.

I made two of my friends sign affidavits for me, attesting the marriage and relationship... USCIS accepted them without problem. I notarized it locally, not in the US Embassy.... so I think you'll be alright.

Keep your fingers crossed. Hang in there, you might be stressing out for nothing.

uhmmm... well, i thought your husband's student visa is going to expire within the year also?

You'll get approved soon... can you take a vacation? Fly to Paris for a week, as you have planned before.

Might do you some good... I wish I had that option.

we all have the option to choose which country to live with, but i would tell you this... it is really really really hard to move away from where you grew up, as the beneficiary, while it is great thinking that I'm going to be with hubby in the US, somedays I still can't imagine life away from my own country. It takes a lot of energy not to get overwhelmed by all the changes that comes with marriage and couple that with leaving behind all the things that you know and people that you care about... that's really a lot. There's a lot to think about... when you are the immigrant. Not shooting your idea down, just saying... don't be too quick to jump out of your country into the fire. :)

As others said, I think the affidavits from you guys wont hold as much weight as from family and friends.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks Lisa, as you can sence, my heart is low, our lifes revolved around a decision by USCIS. Its no way to live.

Freedom of choice does not count with USCIS. For a couple who have been together 3 years, 4 vacations together, pics, emails, chat logs, joint banking, credit cards, insurance on each other, and everything else, consummating the marriage is on their minds. Well we did not have seprate rooms, much less then seprate beds. Thank You baby girl.

Beth you will be fine,

I do believe the evidence you submitted will satisfy the adjudicators. In a perfect world we would all have sacks of evidence that we are that picture perfect image of a married couple. In your own particular situation they just wanted to clarify the consummation of your marriage for which I believe you have adequately done. I have every faith in the evidence you submitted and although they do ask that you may submit affidavits to support your I-130 application it is not mandatory. Also there is no requirement for them to be notarized.

Beth you WILL have your approval and it would not surprise me if it wasn't by the end of this week. The community is all here for you Beth you are very much in our prayers.

You are one of those that, I am always on the prowl seeing if you have gotten your approval yet. Im rooting and praying for you guys. You are a sweet lady and you have a cheerleading section over here on VJ :P

The RFE was a good thing, at least they are actively working on it. I truly believe, as naive as it may sound... that you have not been carried this far and gone through so much to be dropped on your @ss.

Keep the faith and PLEASE dont lose hope. As aweful as this whole process has been to you, it does have an end. You WILL come out on the other side, TOGETHER.

No mama, it wouldnt be a conflict of interest. My husbands best man (he signed as a witness on our marriage certifercate too) did an affadavit for us, and it was accepted. Stay encouraged mama Paris, we'll get thhrough this! (F)(F)(F)

I don't know what they do in Paris but we stayed in several hotels in Italy and each time we were required to both register and provide ID/passport. When we got our receipts back both our names were on the receipt. Not sure if your hotels made record of both of your ID, if so they can provide proof that you were both there on the dates of your honeymoon. I don't know too many people that stay in hotels on the honeymoon and don't consumate the marriage :devil:
