Hello,

My wife and our baby are traveling to the Philippines and planning to stay for about 5 weeks. I know that a US citizen is not supposed to stay beyond 21 days without approval from the BI. But, this is a baby, and she is only staying a little over 30 days. Will my wife still need to go to the BI and file for the extension for the baby, or will there not be a problem when they go to Manila to leave beyond the 30 day limit with no extension?

Have you filed for AOS? You should have AP if not approved for AOS yet (I am confused by your info - says K1). The baby should be a US citizen and should have a US passport I believe. Good Luck

Don't know the answer, but as this is a question about Philipine law, you may be better off posting this in the regional forum.
