Then don't go that avenue. Abandonment charge requires a year of abandonment anyway, doesn't it?

Divorce can cause a lot of grief to both parties. If you try to take care of him and be nice through these hard times, hopefully he will do the same for you.

Maybe it would be better to try and divorce instead of waiting the one year separation... but then I would have to accuse him of abandonment. Didn't want to go that avenue...

hey resilient. nubby here. looks like we are in the same boat! I will also be filing for I-751 Waiver in about a year from now.

my USC husband cheated on me (with numerous women - i have plenty of evidence) and ultimately ran away with some woman somewhere up-state. so i am now obviously by myself now - have no choice but you know, making the best out of what i have.... staying positive and trying to be happy.

here in this state, the law says we must be seperated for at least 1 year before i can get a divorce. So this is where im at right now - month 1 of the 12 month wait. I will divorce based on 1) abandonment of spouse 2) committed adultery.

the 12 month wait + divorce should all be before my 2-year GC anniversary time limit.

so this is a question for all those I-751 waiver filers = anyone been in the same situation as me - where their USC spouse commited adultery and left them? and did you get approved?

my USC husband has also threatened me and sent me abusive txt messages after he left me. Should i go and make a police report and get a restraining order. Would this be "good" evidence to show to USCIS??

Thanks a lot for your answer, rika. Yes, it seems it will be hard to get answers for the agreement here. I am not working now, so I might go to a Legal Aid consultation soon. It seems most of you waiver people divorced very quickly. Is it because you all live around California? (I mean, easier to divorce). Do you apply for a waiver at CSC if you are from CA area? Maybe it would be better to try and divorce instead of waiting the one year separation... but then I would have to accuse him of abandonment. Didn't want to go that avenue...

there are very few people who filed I-751 with a waiver. And not all of them obsessively hang around :lol:

Separation agreement is not something routinely done, so I hope you find help here, but it is not likely.

Can you ask a lawyer to look at it? Are you happy with what's in it? You could start your own topic and ask for VJ unprofessional advice :)

(of course crop out all the personal info - names, addresses, account numbers etc)

Sorry to hear about your story. Its in your best interest to collect and keep all the good faith evidence. Read the new rules about filing waivers, you need not be divorced. You can file right away as soon as your separated.

Remember the waiver is YOUR application, for an approval they have to see YOUR good faith. You must speak to a reputed immigration expert for your legal options.

My fellow VJ`rs finally yesterday i had my interview and got approved.:))) All of you that are going through this know how it feels to be dragged on for almost two years ,anxiously waiting everyday for some kind of news reading this forum and checking your online status.

ITS A HELL!!! especially after a bad marriage that you are trying to forget and get over it and move on with your life. I just hope and pray that all of you that are reading this and going through that same emotional nightmare would end your journey and feel the same way i felt today.

I got to the ASC 45 min before my scheduled time 9am. I had asked my lawyer to be present (not because that I think he helped me but for that extra piece of confidence and support that i was missing) After paying him 750$ he was late for a half an hour and did not show up untill 9 30

I forgot about all the stress and got furious because when you pay someone that kind of money you expect him to be there to help and not just to add more stress to a already stressful situation.

When he arrived i decided not to say anything because if i did i was just going to make the things even more complicated.

I got called in about half an hour after we submitted my notice.

The officer was nice and pretty young that after walking us ,sworn me and asked me to sit. First thing he asked me was if my divorce was final to which i replied yes. Than he asked me for the previous version of my divorce because the final one that he had was a amended one.

I offered him that and he went and made a copy of it. His second question was if i ever had my identity stolen (which i had -my checking account was wiped off) and he asked me for my password confirming that it was me.

Than he asked me about my ex wife, How we met? When did we moved together? when did we get married and divorced. He aslo said that i have plenty of documents and he asked me for joint health insurance to which my lawyer gave him the extra documents we had prepared(probably most of the stuff that was already submitted with my file.)

After looking at that he asked me about my marriage and asked to see pictures from our marriage, I showed them our two albums and also a big stack of pictures that i have brought with me. He seemed to be satisfied with what i had and he gave them back to me.

He than asked me to explain my divorce, why did we divorce and all the details that led to it. After i gave him a short scoop of the whole situation he said that everything looks good.

He proceed with asking me if i have ever had immigration problems before and if I was arrested before to which of course i answered NO and than he said again that he is satisfied with my case and that he is going to approve my application.

When i heard that i felt like a dropped a huge load off my shoulders. He just said that i make sure take everything that i had taken out of my bag and that my green card should arrive pretty soon and if i don't get noting within six mounts to make a inquiry about it.

I Packed all my documents and he escort us back to the door.I was so happy and relieved that i still can not describe it.

My longest journey is over I am relieved til next year when i am going to file for my citizenship.

I wish all of you ending your journey the way I did Happy and relieved. I know how it feels to be waiver filler and i wish you all the best.

Not enough statistics, you can expect anything from 3 months to 2 years :)

Hello folks,

I am in the process of getting a divorce as well and would be filing a waiver too. Looking at these timelines, seems to me that a lot of these cases are now getting done on a shorter timeline than before. Do you agree?

Wowwwwwwwwwwwwwwwwwwwwwww Rika , Congratsssssssssssssss . very glad for you . now pray for me that i ould get mine approved soon ,not even got the interview date yet .good luck in future life

its been almost 2 and half months since my case is ransfered to local office and still no interview date ,i dont know what is going on ,some one have idea ?

Most likely your local office is very busy...

You could make an infopass, visit them in person and ask them if everything's OK.
