hey everyone, i had a quick question maybe someone could help us with.

My wife and I are just waiting for her green card in the mail but this made us think about the future and retirement and things like that. my question is, what if my wife and I wanted to move back to Canada (she was born there) years down the road. Are we allowed? more paperwork?

Thanks!

Of course you are allowed to leave the USA, but she may not be able to maintain her "residency" here unless she naturalizes. google "maintaining permanent residency"

In addition. as the USC, you may face more paperwork with the Canadian immigration service

As has been answered, yes you can move back. But if your wife has not naturalized (ie, doesn't have her US passport), then if you ever decided to COME BACK to the US to live again, she would no longer have her green card. Those with LPR status can only leave the country for a certain amount of time per year (correct me if I'm wrong, but I think it's maximum 6 months out of a year). So if she was out of the US for more than that amount of time, her green card would go away and you'd have to start all over again if you decided to come back to the states. Also, if you do decide to move to Canada you have to do their equivalent of the K-3/CR-1 visa.....

Good luck!

Hi,

As people have already pointed out, if you come to live in Canada for several years you will forfeit her U.S. PR - so worth investigating her applying for U.S. citizenship before you make that move (and yes, she can keep her Canadian citizenship as well).

As for Canadian immigration, sure you are allowed (unless for some reason you are not admissible - criminal background etc) - and of course there is more paperwork, it is immigration after all!

There is no equivalent 'K3' visa for Canada - you are simply sponsoring your family member. You send all the paperwork in at one time, no back and forth - you have 2 ways to do it, inland (you can live with her in Canada while it is being processed) or outland, you can apply from the U.S., for instance.

The process is far simpler than the U.S. process.

All the details you need are here:
