I recently had my case returned. USCIS recvd it in a little under a month. Hopefully they will review quickly but in reading all the entries of others' it does not sound likely. Read some of the other threads and you can get more info about how to handle. Contact your congressman/senator, send for the consulate notes to see exactly why they sent your case back - thru FOIA. I also contacted the Ombudsman. Still waiting as USCIS just received my case back on Friday 5/22/09. Wish you luck...

I email the US consulate, this is what I received:

Dear Mr.

After a thorough review of the facts of this case, the petition was returned to the U.S. Citizenship and Immigration Service (USCIS) where the petition was filed on April 17 for review and possible revocation. The visa applicant was informed of this decision directly by our office, and all personal items submitted in support of the application were returned to the beneficiary at that time. This case is now closed in our office.

Should you have further inquiries, please contact USCIS directly.

Sincerely,

Information Team

I hate to be the bearer of bad news but our I-129 was returned to USCIS in April 08 and we still have not heard anything on it nore do we know the reason why it was returned. I wrote to state department, ombudsman, congressman even to President Bush last year and nothing happened. Numerous calls to USCIS were asnwered with it could take up to 2 years for a returned petition. We since got married and filed I-130 end of March. So we are startign the waiting game all over again. We have been in the system since Jan 07. I pray this willnot happen to you and I wish you all the best of luck in getting everything cleared up.

Thank you to all of our Friends who gave their best wishes and support. To those of you who are still waiting; never give up. It will happen for you.

Sorry to hear that they are sending your case back. I know what you are going through. Our case was sent back in Aug 2007. In Dec 2007 I got a NOA for the case being received at the CSC. May 2009 I finally got our NOIR. The CSC gives you about 30 days to respond to the NOIR, so be ready before the NOIR arrives. You may be in for a long wait too. The only thing I can suggest is keep gathering bona fides and growing your relationship.
