Hi All,

Recently I posted that after attempts to move me and my husbands case via the Senator's office that we got a 24 month waiting time for a review of our case sent back to the US for revoke/review. We are married more then 2 years now.

I got a new shock a few days ago after speaking to Attorney. I approached him upon suggestion with this group. I feel blessed! I thought things were bad, I figured I did something wrong. Found out I didn't.

He explained my Hubby never interviewed for his spouse interview, it was sent for revoke before we went to the interview!

Our case was never sent to the Embassy in Nigeria, that my husband interviewed for an expired I-129!

It may expalin with the missing letter of approval and paperwork, some strange letter in Spanish from uscis and a weird interview and more.

And also perhaps our missing paid but never seen medical exam from 2008 is with it!

We went through great hardship to fill the obligations and pay money to complete everything. My poor Hubby was put through a nightmare.

I spent 2 years to find this and I cannot help but think what is next, why this happened and how much longer it takes to fix it. I am not sure if I will be able to get Marc to take our case on. There is much more that I don't want to go into here now. I did not think the battle would be this one. I don't know if anyone has experienced this.

Yes, I do wonder what happened with the lawyer. They seemed to do everything possible but have disappeared off the planet, I did not put alot of money into them. I am worried their mistakes may impede us. I hope this new lawyer may take us on... I hate to blame the well-meaning lawyer. Now I am not concerned about blame but what to do about it. The other new lawyer advised I get my file.

Also the other lawyer explained what was done by the embassy was illegal... [sigh]

AQ, make sure you verify these things yourself. Have you compared the case number on your K3 to the case number on his denial notice? If indeed it is just a mix up of cases, I would think you (and your senator) could call the embassy and straighten that out.

Also, the I129 you mentioned was is for a K1 or a K3? I think its unlikely that your hubby was scheduled for an interview off of an expired I-129. A NOA2 is good for 6 months, and then it is automatically renewed by the embassy if they have not yet scheduled the interview. I don't know if the embassy will auto renew more than once, and for certain if the person is a no-show it is denied and returned to the US.

However, the consulate does make mistakes and it seems like they probably made several in your case. Please do look closer at the timing of the events. It seems as though there were two petitions for him which overlapped.

momov31 Thank you for your words of encouragement...and reeses thanks for giving me something to look into. The I-129 interview was an non-immigrant visa, it was never renewed, but I didn't realize that. Our other interview I-130 approved petition stayed in the US for approx 2 years - it never went to Nigeria.

August 16th, 2004 fly to Nigeria for Victors interview

August 19th, 2004 Interview date, visa approved.

August 25th, 2004 Victor picks up passport with visa stamp.

August 26th, 2004 fly back to USA

September 18th, 2004 Victor arrives in USA, Lord willing.

October 9th, 2004, we become husband and wife

October 25th, 2004 I learn that I'm pregnant.

Feburary 25th, 2005 AOS Appointment

( went to appt. and requested a reschedule)

June 7th, 05 gave birth to a boy child.

July 5th, 05 Victor packs he suitcase and leaves for good.

July 2005 2nd AOS appointment

( went and requested a reschedule )

August 2005- I file for divorce. and withdraw immigration paperwork.

They don't have to tell you that they renewed it.

The NOA2 for a I-129F is valid for 4 months from the approval date. If an interview is not scheduled within the 4 months then the embassy will automatically extend the petition until they can schedule an interview. For example, a lot of people going through Ghana interview after the expiration of the NOA2, but there is no formal notification of the extension. Interviewing after the expiration is not going to jeopardize your receipt of a visa.

From your profile it looks like you filed for a K3, which is a nonimmigrant visa. In that situation the I-129F will go to the consulate, the I-130 will stay in the US and used for adjustment of status.

The consulate can renew the petition and you wouldnt be notified. I HIGHLY doubt that they would interview him if the petition was expired.

Again, your 130 not making it to the consulate is no suprise. If you dont persue the 130(CR1) with NVC after approval, it will never leave the US. That is the point of the K3.. to give you a choice to either interview with the 129f(k3, nonimmigrant) and then adjust status based on the approved 130.. or wait for a 130 interview date and interview for the immigrant CR1(130). NVC does not automatically send the 130 to the consulate as all of its processing after approval is done at NVC.

I hope the new lawyer can help straighten all of this out for you so that you know where you really stand and how to proceed.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Your lawyer really dropped the ball.

Although the financial obligation and time wait just got bigger, I feel your post more hopeful.

Originally you though he was denied, but in fact he just did not get an interview. So he is not denied. NOthing some more paperwork can fix.

All in God's time. So sorry for your troubles. I am frustrated just reading from you. I can' fathom how you must feel.

Hello to everyone on this thread and thank you for all your input. I wish I could address each one by one. I am so frustrated, I don't know quite which turn to take. We will finish it, I think idocare suggested living with my husband in Nigeria and I really truly wish I could, I am still looking into that and I think you're right - we need to just live together where we can.

I have so many questions I feel my head is spinning. The new attorney I contacted was Marc Ellis, I could tell he knew what he was doing. I hate to mention the other lawyers name, it was recommended by someone reliable but I recently found out that the attorneys spouse who signed everything was the "real" attorney and that they did the paperwork. However I am wondering if they did everything correctly, I'm second guessing everything.

Marc said the I-130 not being interviewed cannot then be revoked but that some embassy's are trying to do that to save time. We did not fill an I-864 and DS-230 & change of agent form. We paid no fees to NVC either.

I too thought that the I-129 did not expire, that it automatically renewed but Marc said it did not in our case - it did truly expire.

I could not be more confused. Perhaps it's the lack of sleep. [LOL.] I want to get on top of this. I don't know what questions to ask and who to ask them. I don't know what to read to clarify my own understanding.

I am preparing for the "rebuttal" that is evidence to provide of me and my Hubby's relationship and to combat any of the issues that arose from our first denied I-129 interview. Other then that I am not sure what else I can do. With all the conflicting information I feel confused. Marc E suggested getting a copy of my entire file from my current lawyer. He also suggested that NVC may have sent these lawyers our I-130 packet.

I definately don't want to go from the frying pan into the fire so to speak. I feel since Marc E deals with only denials he is very knowledgeable and could possibly put together a good defense for us but I also wonder if our other lawyers did what they could and can do what he can. How do I dissect this?

Queen, I cannot imagine what you may be feeling as of now, but would like to applaud you for your true preseverence and dedication . Though I'm new to this journey, reading your experience and others lets me know how really stressful the process can be. Waiting alone is a stressor, then having to deal with a faulty process. I don't see how that even happened. They messed up and want you to wait longer for their mishap? If someone would have told me years ago that I'll be in the middle of long distance relationship and petitional process I would have tried to avoid it at all costs. I love my husband dearly and cannot imagine myself being with another, but it can be draining. My husband I have been in a relationship getting close to 5 years and it has not been fun being apart.

I know it's hard for you and your dear husband. I know you are tired of people saying that they will be praying for you at this point, but I will say You all will make it. Just stay strong like you are doing. Just think about the children of Israel, they kept going until they reached the promised land, regardless of all the set backs.

I'll keep my faith strong and believe that your husband will be with you this year by God's grace. Take care of yourself.

I agree with the statement here me personally I would look into moving to another country this is your husband after all. My next trip to Guinea I plan on buying some land and begin to build a house there. Life is to short to be so stressed out. Fed tax, state tax, city tax, school tax property tax , cable bill,parkinging tickets. Etc.... life is to short follow your heart and be with husband don't let something like this discourage you
