At NVC now, when / how to drop K3 vs IR

Timeline

Hi

we have a NVC number for the K3 and one for the I130

both were entered on May 18th in the NVC system

we received already a mail dated May 21 saying that within a week the petition will be forwarded to the

visa issuing post overseas (french embassy)

we have not received yet any mail about I130 but on May 22nd noticed lawyer was mentioned in the VCR and sent

a mail asking to remove lawyer

When / how to drop K3 now?

could you help please?

I-129F NOA1 : 12-04-08 I-129F NOA2 : 05-14-2009 Took no action since

NVC

Case number assigned at NVC : 05-18-2009

Case Completed at NVC : 08-03

Interview scheduled: 08-13

Embassy

medical : done 08-17 + pick up 09-08

Interview Date: 09-08-09

Visa received : 09-11-09 valid till 03-10-10

October 10th entered US with Visa Waiver Program for 2 weeks holidays (not usual with visa received!)

had to go through secondary inspections to explain

November 25th entered again US with WVP, officer did not notice my green card visa

left US on dec 28 to avoid meeting the substantial presence test for IRS

Jan 9 2010 entered and activated green card though PHL port of entry

waiting for SSN requested with DS230 and 10 years GC

01-30 received tracking number for GC Welcome issued on 01-27

but not yet SSN

SSN expected by Feb 20 else I might go and ask for one regardless of DS230

GC expected by March 27

Feb 3 2010 update card ordered says to allow for 30 days

Feb 8 2010 update saying approval notice sent

Feb 12 2010 received GC card Permanent resident valid till 2020

Feb 18 2010 went to file ss5 for ssn card as not yet received and center would not find me in ssn files

Yes my freind we are having same situation we got same notice for our K3 VISA stated that within a week case will be forward to US EM but we contacted our lawyer and told we want to do I130 IMMIGRANT VISA so Lawyer did paper work and said we should wait untill NVC will request you for Payment of fee then I130 will transfer to US EM .I pray that we all will get our visas smoothly.

Hello there all, I am almost in the same situation, me &my hubby's I129 & I130 approved in Feb, he wants to persue the I129.. we were told it would be mailed in one week to the embassy in Jamaica.. that was the week of Feb 18.. but we still haven't heard anything from the emabassy.. the NVC keeps telling us that it mailed on 2/13.. and they don't know the status of it after it left the NVC.. does anyone know usually how long it can take to hear anything from the embassy?

look also at timelines and contact other people processed by the same embassy

between you and me it seems long

Mrs. Hamliton, e-mail the embassy and ask them if they have received your I-129. You need the case number that NVC assigned you when it was sent on. Here is the e-mail address,

Consularkingst <consularkingst@state.gov>. You need the KNG number that was assigned by NVC. I don't understand why you have waited this long to ask... It is my understanding that a I-129 petition can expire, so please get on this TODAY.

If you have 2 petitions K3 and CR1/IR1, you can go which ever route that is ideal for you. If you want to proceed with CR1/IR1 over the K3, then just ignore the k3 processing and wait for the CR1/IR1. :thumbs:
