Possible to transfer visa to new passport???

Hi!

I've got a question I was hoping someone could help me with...

We've applied for a K-1 Visa and I have the interview next week. We are planning on getting married in August and going on our honeymoon (Hawaii so within the US but requires flights) in October. My fiancé just booked the honeymoon and he booked me as having his last name, not my maiden name. And that's what my question's about...

I will be changing my last name after the wedding. I am planning on getting a new passport that shows my new surname. That however means that neither my K-1 visa nor my I-94 arrival departure record will be in my new passport. Has anyone been in the same situation? Is there a way to get a new K-1 visa in your new passport?? Because I'm assuming if I use a new passport without any visa or I-94, they'll be asking me at the airport to prove that I am in the country legally!?

The other option is keeping my old passport however then we have to change the ticket to my maiden name as my passport would be in my maiden name... And since I'm changing my last name after the wedding, my maiden name would not be my correct name anymore.

Anyone been in the same situation? Is it possible to somehow transfer I-94 and K-1 visa from an old passport to a new one?

I'd appreciate any advice!!!!!!!

Timeline

Your K1 visa is canceled when you enter the US. The I-94 is the only document that means anything after that.

I've heard others recommend you just bring a copy of your marriage certificate with you. Since you're not leaving the country, it's not likely anybody will even ask to see your passport.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Once you enter the US - the K-1 visa, for all intents and purposes, is done with. (it's a one time use).

Your I-94 will become irrevelant when you file for the AOS (and get the NOA) - plus any travelling after you arrive will be with the AP (if you leave the US). So, as long as you are travelling before it expires, your ok. If your not, I would wait till you have the NOA for the AOS, even if travelling in the US. (technically, when the 94 expires, and you don't have the NOA for the AOS, your out of status, subject to ICE problems)

I wouldn't recommend on booking anything - until the visa is in hand, unless you have some means of changing the plans on the go.

If you are travelling in the US, your old passport will be all you need. If you still want your name to be changed - you will have to apply for a new passport at your countries embassy in the US - then travel with that.

You still can use your old passport in your maiden name, and have the tickets in that name, even if you change your name after marriage.

It will take some time I would think to get the new passport anyway.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

when you get a new passport you typically get the old one back... just carry both passports... problem solved

Changing your name takes some considerable time, it will not be done before your honeymoon unless your honeymoon is 2-6 months after the wedding.

Your fiancee should contact the airline and see if he can chage the name on the ticket, they may take pity on him if he explains. Failing that, bring a certified copy of your marriage lisence and hope for the best.

Thanks!!! That's a good solution. I'll bring my old passport, new passport and NOA1 from AOS. Better to bring too much than too little. :) Would probably have been easier if we'd book the trip in my maiden name but now I think it's too late to change so this seems to be the way to go.

I only checked Swedish authorities and changing my name with Swedish authorities will be very fast and then it takes 1 week to get new passport at the Swedish Embassy in New York. And in the US I thought my name change was done through the marriage certificate? But maybe I'm wrong? I will ask my fiancé if he thinks there is a possibility to change my name on the tickets. That would probably be the best idea!!!!

That's a good question. You need to ask the Swedish consulate in the USA. For Ukraine it would not work because the Ukraine consulate here will only do passports and changes for Ukrainian citizens registered IN UKRIANE as permanent US residents and you cannot do that until after you are a permanent US resident. Otherwise it is back to Ukraine for you! And you can't do that because you cannot travel without the AP or green card. Maybe Sweden is different. If their consulate says "c'mon in" with your marriage certificate, then by all means it is possible. (I cannot comment on their time frames, bu they can tell you) It is even possible (but not likely) to get a green card in that time frame if you hurry. But STILL the airlines are pretty insistent that the tickets match the passport, or whatever ID you present (it doesn't have to be a passport to LEAVE the USA, or travel within the USA) Maybe you can get a drivers lisence? My wife had her Vermont drivers lisence in two months and had to learn to drive first! But whatever you present with the ticket, the name should match the ticket.

It is best to be safe. You are dealing with multiple governments here and governments do not tend to be too understanding of urgencies regarding plane tickets and honeymoons. They kind do things at their own pace (as you have seen in this process) It is unfortunate, but until all is said and done, you have minimal control over future plans and it is best not to try and change too many things at once. If he can change the name, it would take a lot of pressure off the situation. You have just compounded the stress level and urgency to get things done. Why? For a name? I wouldn't want anything to ruin my honeymoon and wouldn't care what name was on the passport or plane ticket that got you there. I always go for the path of least resistance.

Thank you so much for all your advice. My fiancé thinks I might be able to travel on Connecticut ID card so we will check this out. That is how he travels within the country. When we get a CT ID card for me, then it will be after the wedding with my new surname. You mentioned that your wife got her driver's license. I am planning on that too. So somehow I think it will work out. It would have been easier using my maiden name but thankfully there will be two and a half months between wedding and honeymoon so we will have some time. Thanks again for all your advice and thoughts!!!!!!!!!!!!!!!!!!!

Yes, you can travel within the USA on a state issued ID card, no problem. Here's the next challenge. What does CT require for an ID card? In Vermont you need the I-797 from your AOS filing and copy of marriage lisence for a K-1 to get an ID card (or drivers lisence) This means...get married, file for EAD, wait for I-797 and go for the ID card. Probably do-able in your time frame. But many states require you to have an EAD or green card before they will issue an ID. Check with the state on this.

Definitely! My fiancé was a little bit too quick and too romantic and wanted to book everything for me as his mrs... And I was very excited when I found out! But then we started thinking about the practicalities.... So definitely would recommend others to book in maiden name! We are lucky we have quite a lot of time between wedding and honeymoon.

It is a good solution, for some countries. In the US, you get your old passport back. In my wife's country you definitely do not get it back.
