Hi,

My wife and I were married in January of 2007, we applied for a K-3 Visa which was granted November of 2007, She entered the USA and we applied for AOS in the month of August 2008... at that time we were married less than 2 years. We got our AOS interview in March 2009 and after the interview she recieved the Green Card in the mail about 2 weeks later.

What is the best way to know whether this is a conditional green card or not, when we filed the AOS paperwork we were married less than 2 years, when we went for the AOS interview were were married for more than two years.

Is there a way to tell if the Green Card is conditional or not?????

Well it should not be conditional. It is based on the date the card was approved. If you were married two years or more on that date it should not be conditional.

When does the card expire? A conditional card is only good for 2 years. That's the easiest way to tell. Example mine was issued 05/14/2007 and expired on 05/14/2009.

I think it says on one of the letters that they send, that it is a conditional card as well. I can't quite recall, but I believe there was something.

Yes, just look at the expiration date. Also, they would have told you at the interview.

On the NOA for the I485 it says if it is a 10 year validity card or a 2 year. Hubby and I have been married for less than 2 years at the date of filling, but more than 2 years at the date of interview, and the NOA says that the card is valid for 10 years.

11/17/08 : Application sent (I-130, I-131, I-485, I-765)

11/18/08 : Official receipt of documents stated on I-797C (Signature for receipt at USCIS was on 11/17/2008 at 10PM)

11/28/08 : NOA Received ( I-797C) for all 4 forms (forms issued on 11/26/2008)

12/18/2008: LUD on I-130, I-131, I-765

01/29/2009: Bio done

01/29, 30/2009: LUD on I485 and I765

2/10/2009: issued AP, valid 1 year for multiple entries.

2/23/2009: Got EAD card

3/8/2009: LUD on all applications. Shows approval of I131 and I765, still pending on I130, I485.

04/28/2009 at 9:30 AM: Interview. Told to wait 90 days for a resolution by mail.

05/01/2009: Card production ordered.

05/06/2009: Received approval NOAs for I130 and I485 (welcome notice, 10 years card). I130 still shows case received and pending.

06/18/2009: got the 10 years validity card. Process length: 213 days since sending the applications.

No RFE at all along the process.

What is the expiration date? If it is 2 years, it is conditional, if it is 10 years, it is unconditional

On the NOA for the I485 it says if it is a 10 year validity card or a 2 year. Hubby and I have been married for less than 2 years at the date of filling, but more than 2 years at the date of interview, and the NOA says that the card is valid for 10 years.

then it is unconditional. You met the conditions prior to issuance. Congratulations!

First you look at the GC dates, you can easily see if it is conditional or not.

For future reference, the rule is as follows mathematically :)

{Interview/AOS Approval Date} - {Wedding Date} < 2 years ========> 2-year Conditional GC

{Interview/AOS Approval Date} - {Wedding Date} > 2 years ========> 10-year Unconditional (Permanent)GC
