Stupid Q. Who files the waiver?

Timeline

New to this, who would file the waiver? I'm the USC with a clean record, my fiance is a UKC with convictions. Does my fiance file the petition or do I? If we get a lawyer, does he do it or do I? I went to immigrate2us and i'm more confused then ever haha.

Don't give up. Immigrate2us is the best place for information on this. Did you post there?

The USC must file the waiver and submit evidence of why the USC would suffer extreme hardship if the visa were permanently denied. You can get a lawyer (make sure they have lots of success with approved waivers) or you can do it yourself. Your choice. Definitely use the resources on i2us. London is not one of the hardest consulates, but it's no picnic either.

Long story short, we have a complicated case. We've been at this for nearly 5 years. You can read our story here. I highly recommend our attorney Laurel Scott, as well as attorneys Laura Fernandez and Lizz Cannon .

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

BTW, I forgot to mention, I can see where the confusion comes from.

The USC prepares the waiver, but the alien physically submits it at the consulate. Make sense?

we went for our interview in CR 4-24-09. We weren't denied the visa, we were told he is not allowed to be admitted to the US due to his unlawful entry in the US in 2005. He is able to file waivers... SOOOOOOO

Our attorney is preparing the waivers and I have to fly back to CR to attend 2 more interviews where I submit the waivers. The Interviewing officer has to prepare a recommendation for the adjudicators in Honduras ( where the waivers get processed for Costa Rica) We are possibly looking at another year of processing. The attorney told us its more like 6 months. Either way.... the clock doesn't start ticking until I can get back to Costa Rica to attend the interviews,. Every embassy is different.... The waivers cost $545.00 each for a total of $1090.00.

We need 2 waivers I-212 is the waiver asking to be allowed to enter the US again and the I-601 is the hardship waiver. All waivers get processed in Honduras for Costa Rica. The embassy is very busy . The officer told us the wait is about a year. My attorney said it is more like 6 months.... I'm leaning toward what the embassy told us since it took so freakin long for the USCIS to even look at our petitions.

Now that the holiday is over, I will be hounding my attorney so we can get the paperwork complete so I can fly back down there and get the clock started. This whole process is so annoying.

We need 2 waivers I-212 is the waiver asking to be allowed to enter the US again and the I-601 is the hardship waiver. All waivers get processed in Honduras for Costa Rica. The embassy is very busy . The officer told us the wait is about a year. My attorney said it is more like 6 months.... I'm leaning toward what the embassy told us since it took so freakin long for the USCIS to even look at our petitions.

Now that the holiday is over, I will be hounding my attorney so we can get the paperwork complete so I can fly back down there and get the clock started. This whole process is so annoying.

The USCIS is ridiculous..... When we filed, the USCIS was soooo backed up. It was taking them forever to approve petitions. But of course, as soon as we got our approvals.... they picked up the pace and now its more like 3 months.... and now we face the processing of the waivers.... its depressing.
