salaams everyone, im new comer to this forum, i ve some questions to ask, my case is little complicated....

...im from karachi, i got married in 2007, my husband filed for I-130 in sep 2007, my case was approved last year by USCIS.

but me and my husband had some problems and we were even considering divorce at that time.

--im a doctor, i wanted to do USMLE exams and residency in states. so i applied for visitor visa in august 2008, ans luckily got it and went to states and stayed there for 6 months, i took all my exams, did volunteer research in a hospital and interviewed for residency position. i never met my husband during my stay in states.

--i came back last month, i got residency in a hospital in texas, they sponsored J1 visa, i applied for J1 but visa was rejected as i did nt withdraw my petition for immigration visa.

--now during this time, differences between me and my husband are a little solved, so he sent affadavit of support to NVC and now i sent DS 230 to NVC and waiting for interview.

during this time my husband never came to pakistan.

--now wat are my chances to get IR1 (it will be 2 yrs since we are married in few weeks)

--i donnt have much eveidence to show contact btw me and my husband like joint bank accounts,property,etc

--shud i say at embassy that i met my husband in states?

i would really appreciate any suggestions...thanks in advance.

hmm i hope that someone comes along that has good information for u the best i can offer is maybe have ur husband contact a good attorney to get some answers, its very complicated....

First of all, if your case was approved by USCIS in 2008 and once USCIS sends case to NVC you have 1 year to respond to NVC, has that one year passed yet? If so, you have to start over with USCIS and etc.

If not, your biggest obstacle will be proving to C.O. at interview this is a real marriage. Being in the U.S. and not seeing your husaband does not look good. You and husband need to have good answers as why, embassy may see it as a fraud marriage. Even though a couple have problems, non communication is the worst thing especially during the immigration process.

NEVER lie to the C.O. at embassy , that is the worst thing to do. Be straight, tell them exactly what happened. You need to start gather evidence to show embassy its a real marriage. Im sorry, but this may be a tough case. I truly wish you and him all the best of luck. For this process is tough, it ither tears us apart or makes us stronger.

I would think you have to start the process over-but i'm not an expert. Also you will need to have met your husband at least a couple times in the 2 years and you DO need evidence (mainly pictures) otherwise in my opinion it is likely it will get denied.

Let me make one correction to my original post, I strongly suggest the U.S. citizen (Petitioner) attend the interview with the beneficiary. Good luck on your journey.

NVC has responded to my ds230 that all documents has been received.

--we were married almost 2yrs back, it was a big 3 day function with almost 300 people invited,

i ve pictures of honeymoon as well as wedding pics, wedding cards, and emails and ecards sent to me by my husband over a period of 2 years.

isthis eveidence not enough?

--i can provide affadavits from eyewitness of marriage that it was done in good faith.

Oh yes-sorry I thought you didn't have any pics and such. The only thing I suggest and I agree with Paris is to meet your husband a couple more times and show evidence of communication

Can your husband take a break and attend the interview with you? That will be a big plus.

Technically its not a requirement to have met after the marriage. My own case, me and husband couldn't meet for 4 years after marriage but he did attend my interview and we had some valid reasons which I did address with the CO during my interview.

Your case is different, since you spent 6 months in US without meeting with him and you also have a denied J-1 visa, which kind of makes it look like you are reconciliation with your husband is because of the denied J-1, I am not trying to offend you but try thinking as a CO. So it will be better if your husband could attend the interview, show the CO that you both genuinely want the marriage to work even though you have been through your bumpy road.

just be true to the consule.. so while waitin for your case to be complete.. why not email each other, send ecards, tell ur husband to send a little amount of amount for you AS A PROOF of ongoing relationship.....

the consul might wonder how come you go to US without your pictures together.... do the best as u can....

10-10-2014 Mom mailed the NBI Clearance of my dad


10-14-2014 NBI clearance delivered in USEM


10-06-2014 Visa Issued CEAC


10-09-2014 Got an email that my dad's visa was issued
