Infopass sucked - EAD Annoyance

Hi Guys

I am soooo fed up and just wanted to vent.

I applied for my EAD almost 90 days ago. I was offered a really great job about a week ago and they want me to start on 5 July (this would be about 92 days from my filing date). I accepted and assured them I would have my EAD by then because I can walk in and get a temp EAD after 90 days.

I went to Infopass today to get an interim EAD today. She checked the status of my case and said that my EAD had been approved and had been sent for printing. Because it has been approved she WILL NOT issue me with a temporary EAD. So in other words I would have been in a better position if my EAD had not yet been approved because at least I'd have a temporary EAD in my hand right now.

Instead I am standing by the mail box desperately hoping that my EAD arrives before 5 July. Please keep your fingers crossed. It just seems the immigration process is so backwards and I am so fed up. I REALLY need this job and am so worried I wont have the paperwork in time. I'm so fed up :(

Hi Pink cloud, Sorry to hear what happened at Infopass about your temp EAD. Actually almost same situation happened to me in April. When I went Infopass, was told my card is on printing process then..from that day, in about 5 days or so actual EAD came in the mail:D So I hope yours will come soon too! In case you won't be able to obtain it by 7/5, maybe you could tell the situation to the employer in order to postpone the starting day, if it's possible? Good luck and wishing your best.

Try to talk to the employer to negotiate a later start date.

If I remember correctly, doesn't the I-9 form say that you have 30 days to show the documents to your employer?

I think you do have 30 days.....talk to them and see what they say. I would be horrible to give up on a great job just because you are waiting for the mail.....

I know i was waiting for my renewal on my EAD, They told me at immigration that i could use my stamped biometrics form as a temporary EAD, My opinion would be to start the job, Because you are approved, As the EAD is issued the date it is printed, So your legal to work

Got my fingers crossed that it arrives soon

I actually thought you had three days after commencing employment in which to produce your documents, but I would contact the HR department at your new job to clarify, and they may be willing to push your start date back a few days to give your EAD time to arrive.

Yes, but what documents?

From I-9:

"Employers must complete Section 2 by examining evidence ofidentity and employment eligibility within three (3) business days of the date employment begins. If employees are authorized to work, but are unable to present the required document(s) within three business days, they must present a receipt for the application of the document(s) within three business days and the actual document(s) within ninety (90) days."

pink_cloud is employment authorized.

Sorry to hear they refused you an interim EAD. I agree Yodrak, a print out of your online EAD approval should be enough to suffice the requirements.

Congrats on your EAD! Do you already have a SSN? If not you might be in for a bit more of a wait. I have lost 2 jobs already due to the EAD/SSN. I lost the first one because of my EAD not being ready and the second because it's taking too long for my SSN.
