ok its stupid i know but i know the i-129-f technically belongs to the USC, as only the USC can cancel it therefore it was from the USC that the cover letter for that is addressed and also signed by.

So what about the AOS packet, should the cover letter be signed by and addressed from the benificary OR USC spouse?

To whom legaly do uscis concider this package belongs and has responcibility of?

I would - since your both sending it together - it won't hurt.

Some forms are signed by one person, the others by the next.

The I-485 is coming from the person adjusting status.

I think that the cover letter was from my wife as the person who received the K1 visa. As Bobby said, both can't hurt.

In my mind it belongs to both and it is the resposibility of the USC to make sure everything is correct for his/her spouse. Who would think otherwise? Why would it matter?

Cover letters are completely optional. You can sign it "Santa Claus" if you want, or not sign, or not do a cover letter.

According to the USCIS it is the immigrant's responsibility to file the form, had I told Alla, "Oh yeah...you need to do an I-485, so get to it" she would have replied "No I don't. I am returning to Ukraine, thank you Good Bye"

I can just imagine the horror on the USCIS officers face when he discovers your cover letter was written by the petitioner and not the beneficiary! Lifetime ban for you!

The pining over these inconsequential matters on this forum gets a little ridiculous sometimes.

Perhaps the most meaningful answer is that, if the USC phones USCIS to try to receive information about the processing of the AOS/EAD/AP, the foreign spouse MUST be on the line with the USC. If the foreign spouse places the call himself/herself, answers from USCIS will be forthcoming.
