My fiance doesn't have an interview date yet, but, she was reading some where that for her interview she needs copies of the documents that I filed with the petition, can anyone tell me which documents she will need copies of, from me??

Also, her 10 year old son will accompany her on the visa, she was reading also that she will need a signature from the father of the child, (who is named on the birth certificate), consenting to the child leaving Germany. The father of the child has nothing to do with my fiance or her son, they were never married, the father hasn't paid on the "child support" for at least 2 years and my fiance has no idea where the father is and has had no contact with him for a few years either and my fiance has full custody of the child. Our question is, is it true about this consent letter and with her situation of the father of the child, what can she do????

Moving this to consulate/embassy forum, you are talking about interview, not initial filing of I-129F

It is suggested to send a complete copy of the I-129F package to fiancee for the interview, this should be the originals of the copies sent to USCIS.

You can get a download of packet 3 from the consulate website with all the instructions for the interview.

She will need either a permission letter from the father or a court order of sole custody. You need to decide which is easier to get. When you say she has "full custody" it is by court order? If so, you are fine. If it is by "default" because the father disappears, it is not sufficient.

Be very careful about this "sole custody" as it must be specific that she can make these decisions without the permission of the father. If there is any question, have her consult the attorney that handled the divorce or the court. The consulate will be very particular about this document. We had to do the same, and it was the ONLY document at our interview that I can truly say they studied and scutinized, everything else was just "glanced at".

If you get the letter from the father, it must specifically say he gives permission (or "has no objection to") the PERMANENT relocation of the child to the UNITED STATES. Those two words are very important.

when you say "complete package of the I129f", do you mean everything, all of the evidence and what not? Or do you just mean the actual I129f forms and the G325 forms??

When I went to the interview, I had a copy of everything we had ever sent to USCIS. PLUS all the documents for the interview. You probably will not need most of it, or any of it, but if you need something, just ONE of those pieces of paper, and it is on your desk 6000 miles away....you will feel very foolish. If you get your visa, you will gladly pack it up and take it home.

Although my fiancee's divorce decree appears to satisfy the definition of sole physical and legal custody - no support was ordered from the father, the children will live exclusively with her, and she will make all parental decisions about them - it doesn't explicitly use any language like "sole custody", and even allows her to consult with her ex-husband on matters relating to the children, if she wishes to. I was advised to get the letter from the father because the consulate would probably not be willing to take a chance on it.

It may be moot, because the youngest will be 18 in early January, and she might interview after that, but we're getting the letter anyway.

Yes, you want her to have everything that was submitted prior to the interview.

This is somewhat consulate specific and country specific. YES, in Ukraine it had to be notarized and it was the ONE document we had translated in Ukraine and stamped by a Ukrainian translator. Because...in Ukraine, and many other countries, your wife will need this letter to go back and forth until the child is 16 (in Ukraine) or 18 in some countries. It is not just a requirement of the consulate, it is a requirement of the country. Be sure your letter meets the needs of both. My wife and son are in Ukraine now and she has this letter with her along with his birth certificate to prove she is the mother. It is an issue that needs careful consideration not just for the interview. At least in Ukraine, despite the fact he has a green card now, it means nothing. Our son is NOT leaving Ukraine without this letter.

We also had to provide a copy of the father's internal passport photo and signature page to show the signature in the passport matched the signature in the letter. It was a "big deal" as things go, to verify all this was correct and legitimate. I mean, it is not so terrible, but it is something they very much make sure is correct.
