Timeline

Hi,

I recently got my I-485 denied so I will move back to Belgium. I'm planning on transferring the money from my checking account into a brokerage account like e-trade. Since I will start working in Europe, I was wondering how it would work with my taxes on capital gains / dividend gains, will I still have to pay taxes on any gains in the US (since I will also be paying taxes in Belgium), or will I be able to fill out a tax exempt?

Any more info on this would be greatly appreciated.

Since you will not be a RESIDENT of the USA you will be EXEMPT from US Taxes.

Since you will not be a RESIDENT of the USA you will be EXEMPT from US Taxes.

Okay, and since I worked in the US for 6 months, do I still have to file my tax return at the end of the year (even though I will be in Belgium)?

Yes you still file a return for the taxes paid while you were in the USA. NOTE not filing a return will prevent you from getting a refund.

But how would I file? If I file single (since I won't be married to a US citizen anymore), isn't there a requirement that the person who files has to be a legal resident?

I know in 2008, I could only file with my wife (married filing jointly), but I'm not sure if I can file single?

You should be able to file using an ITIN, or if you have a SSN you can use that.

Check the IRS site for publication 17 - read it about filing status etc. - It's meant for 5th 6th level (education) and is quite easy to follow. Good Luck

June 10 Oath Ceremony - Teikyo Loretto Heights, Denver, Colorado

July 7 Received Passport in 3 weeks

Shredded all immigration papers Have scanned images

If you were married even just one day in 2009, you can still file as married for the additional tax benefit.

This is wrong.

If you are married as of 12/31/09 - you need to file as married filing joint or married filing separately.
