Hello all

Ok so i am applying for citizenship based on the three year rule for those married to American citizens. I have been a GC holder for 3 years and am ready to become a citizen.

I am kinda stumped on some questions and would appreciate some help

1) Question 3E on form: I was born and raised in Canada. I am also considered a Pakistani citizen since my dad registered my birth there when I was 1. I hold an expired PK passport and a national identity card (kinda like a citizenship card). I used it when I go there, basically that card allows me to go visit without a visa.

So do I put in the form I am Pakistani and Canadian? or just Canadian? or do I attach a paper that says I hold Pakistani citizenship and provide details?

2) Question 6 asks for addresses based on people applying on the 5 year rule. I have been a green card holder for 3 years. Do I just supply the addresses from the three years I have been here or add any canadian ones?

3) Question 6B on the form asks where I have worked in the last 5 years. Do I provide employment from only the three years I have been a GC holder?

any help would be great!

1) Canadian.

2) Only list address that you have been at for the last 3 years, time outside the USA BEFORE becoming an LPR (RESIDENT) does not count.

3) Again see my answer for 2) Employment from BEFORE you became a US Resident is not indicated.

They are only concerned with address and residency while you were a resident.

I disagree with the above answers. I would also put Pakistan since you are a citizen of this country. This is evidenced by the fact that you have never officially rejected this citizenship; to the contrary you visit this country as a citizen of Pakistan by using one of their ID cards.

Page 4, part E, second point, If you are a citizen or national of more than onecountry, write the name of the foreign countrythat issued your last passport.

Question 2 & 3.

Fill out the form with the information after you became LPR. Then on a separate sheet of paper, write down the information for the 5 years. The instructions were not clear, so you might as well give them both. I've seen people do 3 years and some do 5 years, they were both fine.

I disagree with the above answers. I would also put Pakistan since you are a citizen of this country. This is evidenced by the fact that you have never officially rejected this citizenship; to the contrary you visit this country as a citizen of Pakistan by using one of their ID cards.

6/17/2010 - Able to see case status "Initial Review"

6/18/2010 - LUD

7/2/2010 - Called mis-information line to put in a service request for STILL HAVEN'T RECEIVED "FP NOTICE"

7/8/2010 - LUD, at 2:32am, received text msg and e-mail for req. for add'l evidence being mailed out on July 6th, believe it's for the FP

7/12/2010 - Received FP notice in mail, scheduled for 8/2/2010

7/15/2010 - Walk in FP

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010

Love it when someone disagrees with something with out first doing some research.

Hey Everyone! I really appreciate all the help! So the only passport I have is Canadian so that is what i will put down since the instructions clearly say so. I go visit PK but only cause my husband's family lives there. Other than that i would not go.

As for the addresses and employment, I will just put down the ones since i became an LPR. They already have the info as to where I used to live anyways.

Hi Canuck_girl,

I have a similar problem too, in that I was born in another country (which I do not have ties to anymore, nor do I think I have citizenship of I think), acquired Canadian Citizenship through naturalization, and am now a US permanent resident (soon to be US Citizen, I hope) after marrying my spouse.

For "country of nationality", I just put "Canada", which is the only country I have citizenship of currently. I have included copies of my Canadian Passport and Canadian Naturalization Certificate to prove such.

Needless to say, this has not caused any problems with either my AOS application or my I-751 application (as for the N-400, I have still yet to find out later on this year).

The problems I did have though was when they ask and put down "country of birth", in which is listed on my green card and other legal documentation. Needless to say, this has caused a lot of confusion in so many ways, both legally and personally.... :wacko:

So for the N-400, I plan to do the following:

-Declare my "country of nationality" as "Canada"

-Include copies of my Canadian Passport and Canadian Naturalization Certificate

-Paperwork stating I do not have any natonality ties to my birth country (copies of correspondence with that country's immigration department that I inquired about recently, which states my legal non-nationality status there)

-Explain in a separate letter, the exact details of my "nationality status"....

-For you, you should:

-Include all evidence of your "Canadian Nationality" and of your "Pakistan Nationality"

-Explain your exact "nationality status" situation in a separate letter.

-And for "country of nationality", write it as "Canada".....(as that's what you are, right?)

Hope this helps, or at least gives you another perspective on the situation.....
