Hello all!

so i have finally gotten a hang on a lot of the documents required for my husband to petition for my GC (please ignore me if i don't use the right terms)

anyway, the i-864 is the only form i have a problem with.

last year (2008) was the first time my husband ever filed his taxes, before then, his mom had claimed him on her taxes and he was in college. Technically, he has only filed taxes once before.

Last year, he didnt make up to the minimum requirements to be my sole sponsor, and since he is a recent graduate and with the current economic situation, i doubt that he would be able to meet the requirments.

we have decided to get my god-father (who is not related to any one of us) to help us act as a sponsor. He has a family of 2 children and a wife, but he is a medical doctor that owns his own practice and makes well over the minimum requirments.

my questions:

how many i-864 are we supposed to fill out? does my husband fill out one form and then my uncle fill out the other one?

for part 1 of the form, it asks: i am the only joint sponsor or i am one of two sponsors; how do we fill that out?

do my husband and my uncle send their bank statements and tax documents out or does my uncle alone have to send supporting documents?

thank you! and i would alsp appreciate it if i am given more information or if there is a sample form that has been filled out by someone whose petitioner could not meet the requirment and had a joint sponsor that i can view, please send me the link!

Yes - two.

for part 1 of the form, it asks: i am the only joint sponsor or i am one of two sponsors; how do we fill that out?

only joint sponsor on your god fathers 864.

Tax transcripts would work just fine.

This only works if your god father is living in the USA and USC/LPR.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

When adjusting status the petitioner is the person filing the I-130 (US Citizen) the Beneficiary is the person receiving the benefit of the I-130, the I-130 dose not use I-864.

As for the I-485, there is NO petitioner/beneficiary, I-485 has an applicant, the person adjusting their status, I-864 is attached to the I-485..

The person who filed the I-130 (US Citizen/spouse) MUST provide an I-864 to sponsor the adjustment of status.

i know that my husband needs to provide a sponsor for me...my question was about filling out the form.

thanks for all your answers, but i am still a little bit confused...so my husband still has to fill out the WHOLE form even though he does not meet the minimum requirements?

Yes he has to fill it out completely even though does not meet the requirements, this shows that he does not meet the requirements and that he needs the joint sponsor. Also he has to attach a copy of his 2008 IRS return.
