Work and AP... possible to apply before wedding?

Hi guys,

First of all thank you so much for your help during those last few months.

I passed my interview 2 days ago; and I couldn't have done it without your help. So THANK YOU .

Second of all; now it's time to plan and I am very confused.

We were supposed to get married in July; but because my fiance's employer won't grand him days off for his wedding; we had to push the date 1 month later.

So that makes me wonder about the papers.

Can I still apply ;

1. For my SSN

2. For my employment authorization

3. For Advance parole

BEFORE getting married. Cause I will be in the States for about a month before our wedding.

I was counting on us getting married in July but I guess not... and I would love to still have all those papers at the time I was planning on.

Also; another question. If I work as an independent, do I still need to wait for the EAD to start working ? I guess so, but I wanna make sure. And you guys know everything.

Wow congratz for your approval, second, sucks that they didn't give your SO days off from work, but hey that means he has job security.

1.Yes you MUST apply for a SScard before 90 days, they recomend not even wait to apply 10 days before your I-94 expires. You will need it for: Health insurance, opening a bank acct, in some states to apply for marriage licence.

2&3. EAD and AP applications are sent with AOS paperwork so you don't have to pay extra to get them.

AOS application is sent once you have marriage certificate and other docs, read the guides.

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

I don´t need patience if I have love. Ah I que Viva mi Guayaquil Carajo!

I have read the guides but it still confuses me sometimes.

What about me working as an independent...? Anyone knows?

You cannot work in the US until you have an EAD - employment authorization document. K-1s are considered employment authorized so they can get a SSN since some states require that for getting married, but a K-1 still requires an EAD. An EAD is granted based upon your current immigration status so if you apply for one on the basis of your K-1 entry to the US and the 90 day I-94, then it can only be issued for as long as the I-94 is valid - 90 days. However, it takes about 90 days to process an EAD so you spend hundreds of dollars for a document that expires almost as soon as it is issued. When you get married, you apply for AOS (Adjustment of Status) and that EAD will be based on the AOS and will be valid for one year or until the AOS is approved - whichever is shorter. So, you will have some holiday time on your hands as you cannot work in the US even as an independent without the EAD.

I am no expert on these things, but if you feel the need to go right to work, a justice of the peace can marry you in 15 minutes after your fiancee gets out of work or on his lunch break. You can then proceed with the paperwork, and have a more formal ceremony when he can get the time off.
