My fiance is coming Saturday on a K-1 Visa. What does she need to apply for a Marriage License in Texas? Also we can't do AOS until after we are married?

In Texas she only needs a passport for photo id. You have to wait 3 days between license and marriage unless you get a judge to waive the waiting requirement. The license is good for 30 days. Go to your county clerk's office, often in the courthouse.

You will most likely need witness(es) when you marry. I doubt you need a witness just to get your license.

Yes absoluetly, you need one witness when you go apply for the licence, I needed one, and also my then fiance needed a notarized letter stating where he lives so I wrote a letter saying he lives with me. You both also need two proofs of ID !!!!

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

We had no witness and if it was required the clerk issuing the license was the witness. :thumbs:

We got a marriage license in Texas- Brazoria County. USC had to show driver's license for photo id. Immigrant just needed passport. No witnesses to get license. We also did not have to have witnesses of the marriage sign. Only the officiant of the wedding signs and dates that he performed it. Next day we took license back to county clerks office and got it registered on the spot. Also got a certified copy that we mailed with AOS.

A license issued in any county is valid anywhere in the state, meaning you could get a license in your county and drive to the beach in Galveston to marry. You register it back where you took out the license.

We got married in Harrison County Texas. County clerk in courthouse. Hubby just needed his passport for ID. The clerk who gave us the license acted as our witness.

Also, if you want to, you can sit through a class on the basics of marriage, in which case the fee for the marriage license will be reduced, and there will be no waiting period. Since the $75 was no big deal and just the beginning of us showering various gov agencies with money, and us not wanting to be bothered with propaganda, we bought the thing on Wednesday, and got married on the courthouse steps on Friday, with some dinner afterward. Just us, the judge, and his lady friend.
