I am having a co sponsor because even though I make enough money now my last 2 tax returns were under the required. The problem is that I did not file taxes on 2006 and they are asking how much I amde on that year, how do I explain to them that I did not work that year? should I send a letter with the affidavit explaining?

While we are on the subject of affidavit of support form.. (and this may sound stupid) if the petitioner isn't employed but is claiming L&I (Labor & Industries), and that what he claims is above the poverty line, can we indicate this as the annual/household income on the form? Is anyone familiar with L&I? Please someone help us out! We would rather not have our forms sent back because of an error... thank you all.

Dor luv, I really couldn't answer that question, but I bet rebeccajo could. That's who I'd be asking on this one (I've PM'd her before - she's very helpful).

If your currently making the level needed - you do not need a cosponsor.

Just show evidence of this, current tax transcript, employer letter, paystubs.

Yes - if you did not file taxes, you will should provide a letter stating the reason (not working), as per the instructions (Use the I-864 instructions for reference).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
