Hi Everyone,

First I want to apologize if this question has already been answered. I looked, but since each situation is different, wasent 100% sure.

So my wife and I got married April 3rd (sweet!). She is from Ecuador. She has already applied for a visitors visa while we were dating and was denied. So I left the US and we got married in Ecuador.

Im in the process of applying for my recidency in Ecuador... We plan on living in Ecuador for a while. But since she was never able to meet friends and family in the US, Id like to do so very soon.

But heres my question: How? What Visa?

We are not immigrating. Just visiting. But she not visiting just as an Ecuadorian, she visiting as the Wife of an US citizen.

Please help me with advice or suggestions.

I don't think she can get a visitors visa since you are already married. you will probably have to file the I-130 and wait. read the guides and other posts relating to visitor visas..... good luck

Just visiting. But she not visiting just as an Ecuadorian, she visiting as the Wife of an US citizen.

Unfortunately she would still be visiting as a citizen of Ecuador (being married to a US citizen does not change a person's status) - US citizen can not petition for a visitor visa.

And good freaking luck getting ANYTHING out of the Quito embassy or (especially) the Guayaquil consulate, where "everybody is a fraud."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

if she applies for a visitors visa you will have to disclose your marriage. Even if she got a visa ( which is unlikely) she might be denied entry to the US. They are likely to think she has intentions of just staying in the US since she has a USC husband.

You don't have to go the whole route of petitioning with the I-130 just to get your wife here to visit your family, that's craziness!

Just wait until you get your permanent resident status in Equador, then apply for a visitor visa for her at the consulate. Once you have permanent resident status in *her* country, she will obviously have binding ties there, and NOT to the US. If you have a home and jobs etc in Equador, plus you're there, is more proof that she will not be attempting to illegally immigrate to the US.

No guarantee of course, but the others telling you to petition for a permanent resident status for her just to go for a visit is a bit over the top. And unnecessary.

I would plan on living in Ecuador long term. Getting anything through the Quito Embassy or (especially) the Guayaquil consulate is pretty grim. Your wife being denied a visitors visa is now a red flag to the consulate that complicates things. Sorry, I wish I could be more positive. My suggestion would be for your friends and family to visit you guys in Ecuador. It would be a great opportunity for them.

I am in the same boat as you. My wife and I was married in Brazil. Right after we got married we went to the Federal Police (the FBI here in Brazil) to get my visa so I can stay here. I found out I had all the paper work they require but the back ground check. No problem my wife would get a visa to visit the US and we would get my back ground check done. WRONG!!! She was told she could not get a visa because her husband was USC and I did not have a job or even residence here.

Of course I did not have a job. I needed the back ground check to be able to get my visa to stay here and work. So I went back and got it my self. Came back here and applied for my visa. It was so easy for me. No interview. No medical exam. No hassle. Just showed them my ML, BCC, and letter from two people saying we was married and living together. Boom Done.

Fast forward 6 months from time i get visa to 6/26/09 I went to the embassy here in Sao Paulo to do the DCF was told that my wife and get a tourist visa now since I have a job, am a resident of Brazil...ect...So we go down on the 24th of June for her interview. We was told if it was denied to come in to the Citizen Services and they would see what they could do.

I know that is a lot but I really hope that helps

4/7/08 Meet for first time.

10/20/08 Married in Sao Paulo, Brazil

11/25/08 Applied for my permanent visa to say in Brazil

12/02/08 Picked up my Blue Work Book.

5/26/09 Go to Embassy in Sao Paulo to fill out the I-130 so my wife can immigrate to the US.

Not to gainsay anyone here, but in either the Quito embassy or the Guayaquil consulate, the chance of procuring ANY visa approaches zero. To put it mildly, these places defy all logic, sensibility, and reason. The recommendation that the U.S. family members visit Ecuador is excellent.

Hi,

Forget about a tourist visa for her...... as my lawyer put it...."The visitor visa process is simply broken. She could recieve a tourist visa only if you believe in and receive a miracle".

Your residency or working here wont make any difference either, I have been living in Guayaquil with residency, and working for the same major company for 6 years.

I am in the same boat as you, I have a great job here and have no desire to move back at this point, I just want to introduce my wife to my family and show her a few sights in my country. She has apllied for, and been denied a tourist visa 3 times. Now I understand that once you are married, they assume you want to go visit and stay and nothing you can provide will convince them otherwise. Each time she went in for an interview, we provided tons of documents proving we both have significant "ties" to this country.....they never even opened her folder. After her last interview I decided it was time for her apply for an immigration visa just so we could make a 2-week trip, but now I understand that you have to prove you plan on living in the U.S. before it will be considered.

So, I guess we wait until we are ready to move there someday and then start the application process, I go and work there, she stays here. What a screwed up system! I have been drafting up a letter to Obama about immigration reform, I'll let you know if he responds.

If you are in Guayaquil. we should go out for a drink....I feel better knowing that I'm not alone now!
