I'm a little confused about question 11 on I-134.

"I intend/do not intend to make specific contributions to the support of the person(s) named in item 3."

Firstly, my fiance makes more than the 125% 2009 poverty guidelines for a household of 2. There is just the two of us. Does he check 'do not intend' because he fully intends to support me and not JUST make specific contributions?

Secondly, his 2008 tax return doesn't reflect his annual income at all because he only worked for his current company for 4 months before the end of the year, so only 4 months of his salary is counted in the return. We fully intend to include a letter from his employer, his most recent pay stubs and bank statement if needed but just incase, we are getting a co-sponsor.

Does the co-sponsor check 'do not intend' as well in this case since my fiance can support me and it is only incase the embassy asks for the past 3 years tax returns or are not satisfied with proof of his current income via pay stubs/letter of employer? We do not intend to ask for anything from the co-sponsor or rely on him except for the formality of an affidavit of support.

And thirdly, am I correct to assume that if he gets paid by the hour, his annual gross income for the purpose of I-134 is

= his hourly wage x 40 hours a week (full time) x 4 weeks a month x 12?

Actually, please read your embassy reviews. Some embassies (Like ours - London) like to see DO INTEND checked.

I have seen that many people get by with a "do intend" + "room and board" (or something equally broad) for the comment. I think that this is especially important for your cosponsor.

Also, as you are reading your embassy reviews, note if they tend towards using past income or current/future income to calculate a person's ability to support someone. You may be able to make the argument (with employer letter stating start date and current check stubs) that while not in 2008, his 2009 and future projected income is more than satisfactory.

Again, these things vary from consulate to consulate, so be sure to do your own reading on the reviews for your specific consulate!
