Hello VJ family. I have learned so much from this site and in my quest to get my fiance a visa.

I posted earlier that the embassy in dakar senegal returned our I129F petition to USCIS for review and they recommended it be revoked. I have ready many threads were this has happended to others as well. In the process I learned that when a petition is returned it may take uscis 2 to 3 years to look at it. I spoke with a rep from my congressman's office today and she told me i should get married and refile because there is not much she could do.

I guess the real complaint i have is that we were not given a chance at the embassy to rectify or correct the problems. And, according to my research the embassy is suppose to allow the petitioner/beneficiary a chance to submit documents and correct problems before they just send petitions back. Further, it's very frustrating because we don't have any real recourse against them - other than starting all over.

I found a very useful thread in the north african forum with links to the DOS directives to the embassies on how to handle petitions before they are returned and what the legal language is.

let me tell you my plan and please let me know what you think.

Geez, what carrier do Senegal use to carry their dip bags? No way a dip bag should take 2-3 months to go anywhere... dip bags are high priority shipments, they do not even get stopped in customs in ANY country...!

It sounds as though marrying and filing for the appropriate visa might indeed be your best option, but someone with more experience or knowledge about your sort of situation could advise you better. It's a shame they would just send your petition back like that... I wish you all the best and hope that you and your SO get to be together sooner rather than later.

July 2007 - met Jesse at a beach party held by mutual friends in Long Island, NY

May 2008 - J-1 visa expired, had to move back to Australia

July 2008-September 2008 - lived with Jesse for three months in Staten Island, NY

March 2009 - Jesse comes to Australia for 3 weeks

April 2009 - Engaged!

05/20/09 - I-129F petition mailed in

05/22/09 - NOA1!

05/25/09 - touch

09/09/09 - NOA2!

10/01/09 - due to fiance's illness, we are abandoning pursuit of K-1 at this point. Packet 3 received from consulate but won't be returned.

I thought Diplomatic Pouches were escorted by someone. What are they doing? Taking a cruise???

I would harrass and harangue anyone and everyone involved to find out what is going on.

if u marry then u start a different application cr1 and basically it will take another year, they tell you most anything they want at the time. Calling, complaining etc unfortunately wont change a thing and our reps can only relay the information between as it is given to them. It is true tho some cases are waiting 2-3 years with still no review so personally unless there is some (very distint) reason you KNOW it was denied (something that still would change the outcome) i would marry and continue on.

Each case is different and only you know if there was real reason for the return with ours we were never told ANY reason the only thing we suspected were the age issues and this cant be changed, after marriage and refile as cr1 it sailed right thru with no issues and visa the next day, so who knows what they are thinking

OMG! :wacko: We are sooo in the same boat. Our case was sent back April 28th. We were told by the consulant and State department to allow 30 days. Yes, are they on a cruise????? I have contacted my State senator office also. THey contacted Casa and received the official memo via emai. I am waiting on the official letter from USCIS then my senator case worker can start inquiring about our case. I agree with everything you said also. Houcine was not given a reason by his CO of why she was returning. He received a 221G on the 1st interview (he had 3). And on the last she gave him another paper which none of the boxes (reasons for return) were marked. He didnt realize it until he sent it to me and I looked. But we were not given a chance either to submit additional evidence either. We have considered me moving to Morocco and establishing residency for 6 months, marrying and direct filing with the consulant. But thats a BIG STEP. Lets keep this going and get some input. I am desperate for info on how to proceed. I had a fellow VJ er tell me to send a letter of rebuttle along with info on the interview and supporting evidence. But I cant do that until I receive the letter from USCIS. I will probably do that along with what you mentioned.

We are in the same boat as well. Flew through USCIS, interview went well, was told we will call and less than a week later, we were returned. No warning, no contact, no 221g, nothing. Moving to Morocco is something we have discussed as well. If I tried to just go there to marry, it would take a month or more and I would lose my job anyway. I have written both Senators, my Congressman, FOIA and I even sent an email to President Obama asking for a review of DOS and the friction between them and USCIS. I don't want to file a new i-129f until I know what the issue is and of course, no one can tell me yet. ~Natasha

Sorry to see that this is still common place. brnidokiegurl definitely knows what she is talking about. our case was denied on december 29, and the USCIS letter was dated on february 4. we have recently gotten married, and will proceed with the cr1 sometime in June. good luck to us all and do not lose the faith :thumbs:

wow there are so many of us in the same boat. USCIS did receive our petition back in about a month - they got it on Friday 5/22/09. now still waiting for the offical letter and responses from the ombudsman, I wrote DOS as well - Hillary Clinton's office. I also think it's a good idea to write Obama's office too about this friction between USCIS and the embassies... This is really crazy... Hopefully it will all work out - I have to believe. We are still getting married when I go and then I will see if I will need to file the 130 app afterwards. Good luck to us all.
