Question about applying for K3 while in the US.

I met my fiance llate in 2008 and have been in the states to visit a number of times. This last time I was there we decided to get married. Now that I am here and married to my lady, do I begin the filing process from here? Or should I go back to Canada and start the process there? I'm hoping that I can do the process from WA state as it's far easier for me to assimilate this way rather than having to return to Canada and begin there.

From what I've read thus far, it seems as though I can file from here. Though I will not have the ability to work. Is this correct?

01/11/2010 - Received Application and signed by JPM

03/10/2010 - Received approval notice via e-mail

06/23/2010 - Returned her passport to Singapore Embassy for issuance of visa

06/30/2010 - Visa Received... Yehey!!

09/16/2010 - Arrived in Hawaii

10/02/2010 - Received Welcome Notice

10/12/2010 - Applied for SS #

10/13/2010 - Received 10 years permanent card

10/18/2010 - Received ss card

Yep, after about four years or so, you may be posting here about citizenship, but first, you've got to get the visa, then the green card, and you've got to hold the green card for a few years.

But yes, you can file the K-3 paperwork while you're in the US. There's no specific requirement about where you've got to be on the day you file.

04 Apr, 2004: Got married

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

But yes, you can file the K-3 paperwork while you're in the US. There's no specific requirement about where you've got to be on the day you file.

Helps to be here legally, even by other means such as a student/work/tourist visa. Purpose of a K-3 is again dealing with the DOS to bring your intended spouse here that may not even be possible by other means. Highly country depended, and if coming from a poor country for example, where your intended does not own property, have a job, and the DOS is iffy about giving you a visa because they feel you have no good reason to return, the K3 can be the only means to bring that person here.

Would hire a good immigration attorney for the best advice, could well be possible, your spouse can stay here and just file an AOS. Not even sure about Canada anymore, if your visits are limited. One thing you do not want to do is to exceed those limits. With all the countries involved, and in dealing with both the USCIS and DOS, can get rather complicated.
