I have a quick question here.

We just received an RFE for our AOS. We are applying after marriage and after I entered the US on a K1 visa.

The USCIS is requesting the following:

"Submit evidence that an immigrant visa petition has been filed on your behalf. Such evidence includes a copy of the I-797 Notice of Action on Form I-129F (Petition for Alien Fiance), Form I-130 (Petition for Alien Relative), or Form 1-360 (Petition for Amerasion, Widow(er), or Special Immigrant), and/or a copy of Form 1-171 (Notice of Approval from the Consular Office).

All I have is a letter that was sent to my husband from the Bureau of Consular Affairs that he recieved stating that the State Department's National Visa Center has recently received an approved I-129F petition filed on behalf of your Fiance, and that the petition will be forwarded to the appropriate visa-issuing post where the interview will take place. It has my name on it (albiet with a misspelled middle name), and INS receipt number, bar code and Case number.

The question I have is that is this the NOA2? If not, is this the notice of approval from the consular office? Will this be sufficient for their needs?

If you dont have it then you need to look into filing this form, its a $200 fee i'm afraid -

edit: Actually I think what you have may be one of the things listed on there, someone can correct me if I'm wrong.

Thanks for your response. So the letter we have is definitetly not the NOA2. I don't know if we can fork out another $200 just to get a copy of something we didn't get in the first place. Does anyone know if what I have is also something they've requested?

The letter you have is not the I-797 Notice of Action (NOA) Approval Notice, aka NOA2. (Nor is it an I-171)

It is, however, what my wife sent with her I-485 in lieu of the I-797 Approval Notice since I had never received one. She included with the letter a printout of the USCIS online status page for my petition showing that the petition had been received and I would be notified when a decision was made - i.e. indicating that although the USCIS had approved the petition, as indicated by the letter from the NVC, they had not updated the notification systems and no Approval Notice had ever been sent to me. These two things apparently were satisfactory since she was not sent an RFE and her application was approved.

Are you sure that your husband did not receive an Approval Notice?

Are you sure that your husband did not receive an Approval Notice?

If he did, I can't find it anywhere - he says he doesn't rember getting anything that looked like what was in the picture - just the letter I mentioned. I checked online and the case status shows approval. He did have a change of address in the middle of the application and although he notified the USCIS of the change, the letter I mentioned was sent to his old address. If the NOA2 was sent out, I'm not surprised if it got lost in transit.

I'll send in the letter plus a print out of the online notice. I'm sure they just want to prove that the I-129F was applied for by my husband and approved.

Definitely worth a try before spending $200 on I-824. Include also a statement explaining why you are submitting the two alternate documents rather than the usual I-797 Approval Notice.
