As I said, in your mind the punishment is entirely appropriate, the complete package, both the custodial sentence and the resulting deterioration in health. He got his just deserts. At least I know where you stand.

Ok just to clarify things. I am not saying this is how we should deal with thiefs, the problem needs to be fixed. What I am saying is that he made his bed and he needs to....

Is society paying more now because he can't work, even should he want to than if he had been treated for his condition and given the opportunity to work?

That's the bottom line.

Never mind the holding institutions accountable, which is obviously fundamental.

The anger is at both places but giving the thief some sort of right by suing and what not will only add to my anger, he has already caused enough grief to society. He made his bed....

So you said.

But the negligence of the prison service caused his disability - therefore they have a responsibility to compensate the man accordingly and to adjust their procedures to ensure it doesn't happen to anyone else.

So what we disagree on is the actions that should be taken with the facility, you say compensate the man along with fixing the problem, I say fix the problem so that it doesnt happen again and make sure its done but it ends there with me. Send a message to criminals, it just doesnt pay. but with your line of logic he can sue and it probably will pay for him, hes probably going to be a rich man at my expense. Explain the justice in that!!!

The justice is in holding the institution/society accountable for it's actions that led to the man's disability and inability to even attempt to play by societies rules. (Whether he would or wouldn't is not actually relevant as we can't assume one or the other). If society breaks its own rules, it has to pay and by paying it will encourage society not to make the same mistake. Imagine that?

He can and should sue - its in the interest of the prison service to pay a penalty in order to force through the necessary changes. Without a court case to draw public attention to it - things like this get swept under the rug and nothing gets done.

None of this has anything to do with "crime paying" as much as the prison service operating in a humane manner that befits a supposedly civilized society. Nor does it have anything to do with the man's crime - his punishment was to be jailed, not to be crippled by blatant negligence on the part of the authorities.

Society didnt break the rules the facility did but unfortunatly we foot the bill. Minimize the burden on society by giving the criminal no right to sue and placing the burden on the facility not the tax payer, rather it be thur firing or cutting back on employee wages. Whatever it takes to implement the changes to the people directly responsable. That is all I ask, I should not be bent over the counter by joe the thief.

If the guy isn't allowed to sue - there is no impetus for the prison service to change the procedures that led to what happened to him (and which could happen to others).

Again - your outrage is misdirected. It should be on the prison authorities for putting you in the position of having to foot the bill for their incompetence.

Society already expressed its outrage by sentencing the man to jail for his crime.

almost all prisons have a paid lawyer for the inmates..sometimes the attorney is split between differnet prisons...i knew the one in kansas well...they are to represent the inmate in any cases against the dept of corrections...and when an inmate gets 'rolled' from one category prison to another..that is rolled from medium to maxium..also, is the inmate commits a crime in the prison...he is usally their lawyer..as the case is heard in the county where the prison is located
