Hi to all Vjers,

My question is that I have an approved AP, a Valid passport & my GC is still in process ( xfrd to CSC). I am going to fly till seattle & then by road to canada. I am taking precautions to avoid any unnecessary issues at the Border security. Do I still need to get a Visa for canada or a passport & Ap is enough for me to travel to canada and be back in US without any issues? I called the USCIS cust Serv & they said that passport & Ap is enough, but i still have doubts.

If any one has any information on this would be appreciated.

Regards,

Amrit & Rob

Does India require an special visa to go to Canada normally?

If so, then you would need that, the AP is just for the US.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks for the reply dear,

However the USCIS cust rep said that the purpose of AP is to let you travel outside US and Re-enter legally. They would know that i havent rcvd the GC that's why i have been issued AP which allows you to travel 7 be back. The Canadian cust rep said that ideally we would need a visa but as we r in process of GC and have entered US legally, as long as we have supportive documents we would be finw without a visa. Supportive docs as valid passport, AP.

What Should I do now. I am still confused on this  . My husband too says the same thing that all I need is a passport & AP.

Canadian entry is reserved for either US Citizens or Green Card holders (holding valid I-551 issued after April, 1996). Advance Parole is used to enter into United States and is not connected or related to entry into Canada. I recommend getting a visa before trying to enter Canada.

The law is that you must have a green card. Perhaps the Canadian representative you spoke to (who did you speak to in Canada btw?) was feeling generous that day and maybe if you got the same person at the border on the day you crossed it, they would let you in.

If you try to cross in to Canada without the proper visa, be prepared to be turned back (ie: it is up to you if you take the risk - they may let you in, who knows, but don't be disappointed if they don't).

In fact, I would think they would be insulted that you are trying to use your temporary U.S. immigration paperwork to travel to Canada.

As pointed out above, the AP allows you to exit and re-enter the US before your able to (with greencard).

It does not allow you to go to other countries, if you need a visa according to where your current (non-us passport) is from.

India requires a visa to visit Canada.

Canada will allow LPR's to enter with the US greencard, but you are not yet a LPR.
