Maybe someone can answer this question for me. When I am trying to figure out if I meet the income amount for support. I know I include myself and my fiance, plus we are having in baby together due in July, but my main question is I have a son from a previous marriage who lives with his mother full time and visits me every other weekend plus I pay child support. On the I-134 it asks me to list any dependents that are either "wholly" dependent or "partially" dependent, my son being the latter of the two. Will they count him also in the size of my family which would make my family size 4 or will they say it's my fiance, our child and I making the family size 3?

TIMELINE:

10/13/09 - Filed I-129F

10/17/09 - Received NOA1

02/23/10 - NOA2!!

02/25/10 - Received at NVC

03/11/10 - Left NVC

03/15/10 - Delivered to Jerusalem Consulate

04/08/10 - Packet 3 received.

05/28/10 - Packet 3 mailed back to Consulate.

06/28/10 - Packet 4/ Interview letter received!

07/16/10 - INTERVIEW!!!

07/16/10 - APPROVED!!!!

08/01/10 - Visa delivered by mail.

10/21/10 - Flew into the US!!! Finally here!!!

11/14/10 - Married!!!!!!!

This is taken from the I-864 instructions (which is used later, but the embassy uses it as guidance)

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, allpersons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or FormI-864 EZ affidavit of support whom you are still obligated to support.

I would go with the count of 4. (but what stage are you at now?)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You do not count your un-born child on I-134 unless interview falls after child is born.

You do count your child from prior marriage.

I-134 is required for interview, not when filing the I-129F.

Oh I am just starting the process. I am just trying to get my ducks in a row so I can plan ahead. Thanks you guys are a great source of information.

Ah - then your baby would be born by the time you would need the I-134/864.

So - you would use "4".

Thanks I can't wait to see the little one, but family size 4 does now cause me a problem. That puts me just under the limit based on my salary alone. I guess I'll have to start looking at assets and my life insurance, etc.
