please someone tell me what i have to do, my husband visa in madrid was denied and they send our case back to USA I keep calling the Embassy but they only answer mondays, thursday, what i have to do to have another interview i know was cases like mine before please help me :crying:

Marriage : Jan. 28-2008 we know each other since 2003

I-129 Sent : 9-10-2008 Your item was delivered at 2:05 PM on September 13, 2008 in SAINT ALBANS, VT 05479. 4 months later because they never send me the receipt was an error in the address

Oh Zarqa, Im so sorry to hear. I came on this morning just to get your news, I was hoping it was good.

Werent you planning on maybe having to file waivers? They didnt even give you a chance to do that? They just denied?

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

oh my god am destroy, since the beginning she don't like my husband, she told him why you look to me over my head? and she said if I denied the visa you will bring your wife here? he said of course and she told my husband this is a fake marriage just like that she don't look pic or anything, I call my congressman they willl call me back and see if they can reschedule new interview I'm keep waiting

I know was case like that before in Jordan someone remember what she did?

did you see the topic pinned at the top of MENA? There are steps to take for keeping the petition there at the consulate.

I remember a case similar not too long ago but I was thinking it was morocco, not JO.

What's the reason for the denial?

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

I really am so sorry to hear that and know you must be feeling so broken but I think

in times like this you need to get more strong! You need to see what are your options, hopefully from this

site you can find another situation like yours and take some information from them.

The congressman is a good start. You need to obtain the release forms and sign them, then they can

intervene on your behalf.

I cannot help much as I have not been in your situation, but I think for you to PRAY PRAY PRAY and do what you can as soon as possible.

(F) I am so sorry to hear of the news. Again, what is the reason for denial? Did they give him a paper explaining?

the reason they said our marriage is fake , the officer ask questions and answer herself, she ask how many times i been married my husband said 2 and he said is not true, he argument because i married twice, so i don't know what is going on, I already spoke 2 attorneys one told me to submit a reconsideration request as soon is possible and if they denied wait until the case is back and after that we have the chance to fight, I am so lost but I will keep fighting

I am so sorry this has happened to you. I don't know any specifics of your case, but the topic pinned at the top of the MENA forum does have information that can be helpful to you.

This is however not a "hard denial" it is a visa refusal by the consulate (DOS)...the consulate is returning the file to the original approving USCIS office for review. The USCIS (DHS) will review the returned petition/application and then send you an NOIR (Notice of Intent to Revoke) or NOID (Notice of Intent to Deny) giving you a specific amount of time to rebut the consular findings.

There is a very short window in which a petitioner has a slight chance in stopping the file from being returned. It does require you to contact your senator/congressman and provide them with all necessary information on the case, and why it is so important to try and turn this around before the file is actually returned. Your government rep has a better chance of getting this reviewed by consular management before it is returned...if you know the reason(s) why they want to return the file, it may be possible for you to provide evidence to them. Not all consulates allow this, but there are a few cases I know of where the petitioner was able to get the file reviewed by consular management and a visa was actually issued without having to go through the return process. It is definitely worth trying.

I absolutely recommend reading this documentation so you have an idea of what will happen and what your options might be. Did he get ANY paper when he has his interview ? They are required to give him a notice if they don't issue the visa. If he didn't recieve anything it may be a wedge that your respresentive can use to get the case held at the embassy. If he was handed anything have him fax you a copy. Also have him write a transcript of what happen during the interview while his mind is still fresh. Include what was said and done even if it didn't seem art of the interview.
