Hello all, my fiance and are are planning starting the filing process for a K1 in the near future but I have 2 travel questions I was hoping you could help me figure out.

A little background first and then I'll get to the questions. I am from the US and she is from and currently living in the UK. We have been lucky enough to be able to travel to see each other during our courtship quite a few times. My first question is once we file the I129 will she still be able to travel to the US? The 2nd question is once the K1 is granted and we are married will we be able to have a honeymoon outside of the united states?

Question 1. Probably. Bring plenty of evidence she will return.

Question 2. YES, provided your honeymoon is after she receives an AP or Green Card...or if before, that she doesn't care if she comes back with you. You can always leave the US, getting back is the problem. She cannot leave the USA, once she enters on the K-1 visa, and return until she has her AP or Green Card.

DURING the K1 process she can come as she wish for as many times as she want. However, when she does enter the U S with her k1 Visa, she cannot leave the country until she has her adjustment of status approved.

Yup I did the same. I have been through the US borders at least twice since filling for the K1 visa.

The latter was only a few weeks ago after I had already received the notification from the US embassy to gather my papers

and inform them that i was ready for interview.

As previously stated. I would be a good idea for your other half to carry a written letter from their employer to state the fact

that they are in gainful employment and that they are expecting their return to work on mm-dd.

I had no issues myself with US border control and never had to take the letter out of its envelope and even clearly

informed them ( when asked the purpose of the visit ) I explained that I was going to spend a few weeks with my fiancee

to help out with wedding plans as we were filling for a K1.

Although my own paranoia stopped me submitting the packet 3 to the embassy till my return to the UK. :D

All right I just wanted to get something clarified on my question. After the K1 is granted but before you use the K1 are you able to travel to work on wedding plans and things like that? Thanks again for all of your help!

You are free to visit her, just ensure you have evidence you will return and DONT lie about anything. Be clear that you are visiting your fiancee but you are returning to work/study etc and that you have filed for a VISA to have her marry you in the USA.

Unfortunatly the K1 Visa is a single entry visa and once she has it in her passport she will NOT be allowed to visit the USA. if she does the Visa will be used up and you will have to get married before she can leave.

One thing to be VERY careful of is once that K1 Visa is used she should not leave the USA AT ALL under any circumstances until she has her Ajustment of status completed. Exceptions to this are emergancies where you file for her to leave before she actually leaves the US border and if you file for permission to leave and re-enter seperatly (takes about 3 months to come in after you send in the required forms and is valid for 12 months, as with work permit)

Hope this helps, Im currently preparing for my interview myslf. So much red tape to wade through!

There has been posts of people successfully visiting on the VWP after receiving their K1 (sorry I couldn't find them). But it is up to the CBP person on the day. It was something I had considered so did follow the issue.

Another option is to either delay your interview for as long as possible, or to request at your interview for a delay in having it printed in your passport. That will depend on the embassy official
