Dear all,

I have a complicated situation. I was just going to file paperwork for my fiance when I found out that I would have to go to China for a work project for 9-12 months. I don't know the exact dates yet, but...

Would you recommend still filing for a fiance visa?

Or is it better to go to China, have my fiance (who is a Russian citizen) come there, get married in China and file for a K3 visa?

Or is DCF available in China? And even if it is, would it be allowed for us if we both are not citizens of China? I will probably qualify for residency but I don't think my spouse will.

There are multiple issues. First, two foreigners cannot marry each other in China. One party must be a Chinese citizen. If you marry elsewhere, she still needs to deal with how she gets permission to stay in China. On top of that, you must be a resident of China six months before filing DCF. Sounds like a lot to overcome but a K1 won't do you much good now, since it's for marriage in the US followed by adjustment of status to permanent resident. To accomplish that, you must actually reside together in the USA.

Yes, it's very complicated.

Can't two foreigners get married in China? I just read yesterday about it, that a Chinese citizen needs to bring this and that, but if both are foriegners, then... So, probably they can, but DCF is another story.

If you can find a way to get married in China, go for it.
