Want to bring Sister to US

:blink: Hello all, I am wanting to bring my sister to the US from the philippines for a temp. visit. I am now a US Citizen. She has a good job to return to, the rest of our family and holds a lease on an apt. I understand this requires a I-130.

My concern is I have heard numerous reports that the I-130 temp. Visa has an extremely high rate of denial.

Does anyone have some solid info. on this? I can't seem to find a sizeable stat. to go buy and everything else is heresay. Any help will be greatly appreciated.

I-130 is for IMMIGRATIONS only.

If sister wants to just visit the USA then sister files a DS-156 to the consulate in the home country, you can send her a letter of invite and perhaps an I-134 to show how she will be supported while visiting.

Sister needs to provide strong evidence of ties to the home country, evidence that she is not going to remain in the USA.

Use Tourist/Business Visa, B1/B2. There is a lot of humor about denial. But there is no harm in trying.

I was able to visit my bf and spent Christmas and New Year there thru B1/B2 visa.

Regarding getting the visa, it really depends.

It depends on how complete your sister's papers are (please read demonstrating ties http://manila.usembassy.gov/wwwhnv03.html) and how confident she is.

Depends on the consul too.

If she is confident during the interview she can just breeze through it. It was only a 3 minute interview but I knew that in the first 10 secs of it, I already passed.

Sample questions are: What is the purpose of your trip? How can I be sure that you will be coming back to the Philippines?

Sorry Ardith but it's "almost" impossible for a younger pinay to get a tourist visa unless they have GOOD reasons they HAVE to return to the Philippines.

The reason is your fellow countrymen have abused the system and ended up going TNT when on tourist visas.

She can try. It will cost her $131 to try. If you do a immigrant petition for her it will take about 22 years.

May as well file a I-130 for her if she wants to immigrate. Time flys.

usually good jobs, owns a house here... business... money.

but if she's young and single, chances are pretty slim.

it also depends on luck, even if you have tons of assets and properties... if the consul don't like you.. you get denied outright.

try though... because lots of rumors lately says that there's a high approval rate.

I have one friend that whose young fiance was able to come visit him and she didn't have much of anything showing she had to return to PI. Also a friend who was pregnant mom made who didn't have much to show she wasn't going to go TNT was approved.

Only cost $131 plus expenses to apply. Doesn't seem to hurt chances of getting a visa later also.

It would suck if they were turned around at POE tho. Don't know how often that happens tho?

FYI, the embassy website says not to bother with affidavits of support for non-immigrant visas.

AFFIDAVIT OF SUPPORT

In general, affidavits of support of any sort from relatives or sponsors will be of little value to an applicant (except to student visa applicants). The Affidavit of Support is a requirement only for immigrant visas. The interviewing officer is less concerned about how the applicant will be supported during his or her stay in the United States than whether the applicant has compelling reasons to return home. We encourage the interested third parties to save their time and money and not prepare affidavits of support.

I would not go by that....

the reason is because a K1(fiance) visa...is NOT an immigrant visa and they still require an Affidavit of support.

So as you can see... they even contradict themselves...or should add this one to the exception too

K visas are non-immigrant visas, but they are processed by the Immigrant Visa Unit. Hence the requirement for I-134 for K visas. The guidance I posted was for visa issued by the Non-Immigrant Visa Unit.

Thanks to all for the great resonse. First a correction, this is not my younger sister but older sister of all children. it lloks like the resonses on whether the denial rate are high or not are about 50 /50. Many recommend that since the fee is only $133.00 to just go for it. I would normally, but that brings up more third party rumors I here. If you are denied this visitors visa, it can adversely affect your chances for another type of Visa in the future such as a K1 which is how I arrived. Apparently they see a Red Flag if that Visa is denied and then later you apply for another type. Comments anyone??? I don't want to kill a future chance of her apllying for a Visa just because $133.00 seemed like a cheap gamble. Any help appreciated.
