Hello. My boyfriend is from Ecuador. We will soon be engaged and we're planning on getting married here in the States. I live in SC. My annual income for the last three years is as follows:

1. 2007 - 17,241.43

2. 2008 - 19,806.41

3. 2009 - will be between 21,165 & 23,000

I also own a car worth about $4,000 and have savings of about $1,500.

1. What do they take in consideration for the 125% poverty guideline? which year?

2. I live with my step-father, my mother & 2 sisters but I pay rent to them, I support myself. Do they count in my household? or will it just be me & my fiance? how many do I count for the poverty guideline?

3. Is it enough income or do I have to look for a sponsor?

Please help me!!

the consulate may or may not asked for the last 3 years of tax return, so it's probably best to get a co-sponsor. the numbers you posted is this the Adjusted Gross income?

8 37,010----- $46,262.50

For families with more than 8 persons, add $3,740 for each additional person

You and your fiance are considered a family of two and thus, based on your 2008 tax return, you meet the sponsorship guidelines. Only if you don't meet the threshold would you need to produce 3 years of tax returns, or obtain a sponsor, or show additional assets. Based on your 2008 income and the fact that you are currently employed, you should have no problem.

The household number is based on the number of dependents you currently have plus the beneficiary. In your case, it would be a total of 2 people, as DGAB2008 said, so you should be fine.

NOTE: You cannot count a car as an asset unless you own more than one car, the second car can be counted as an asset, the reason for this is what would you drive if you sold the car.

In my case I have a daily driver, and a collector car that goes to shows, I could use the collector car as an asset, not my daily driver.

Moving this to Consulate/Embassy fourm, Affidavit of support (I-134) is NOT needed until the visa interview.

This is spelled out in form I-864 directions, the consulates use the standards of the I-864 with I-134 for assets.

You may not include an automobile unless you show that you own at least one working automobile that you have not included.

The numbers posted are what my W-2's say. So, I guess it's my gross income

NOA1 = Notice of Action 1, this paper tells you that USCIS has your petition

NOA2 = Notice of Action 2, usually means Approral Notice...

I will have to check my income tax return tonight. Thanks for taking the time to help me. I have one more question for you: It's my understanding that my boyfriend (soon fiance) has to translate some documents to english, can you tell me more or less what are they? does he have to translate them in Ecuador or here?
