Hello Everyone :) I filed an I-129F petition for another woman I was engaged to in Nov 2007. She wasn't the right one, and the relationship ended badly. I immediately sent a Cancellation letter, but it was too late! It was approved before the service center could match the paperwork. She did not try to pursue the visa any further, and I have not talked to her since that time.

So I have finally found the woman of my dreams, and we are both certain that we should be married. My finacee knows about the previous I-129F. We did our homework and sent a waiver request with the initial submission. Our wait is approaching the 5 month mark and I am worried that this waiver will drastically delay our visa. :(

Does anyone know how long a waiver will increasing processing time? I know everyone's case is unique, but I'm looking for a ballpark answer.

Any thoughts or experiences would be greatly appreciated! :thumbs:

Of course waivers will delay your petition. They have to be further researched.

At the 6 month mark of receipt of your NOA 1 - I would call to see where theya re at.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

My guess is 2-3 years...just teasing. Its hard to say, it does look bad for you when you cancle one then turn around and file another one.

My guess is 2-3 years...just teasing. Its hard to say, it does look bad for you when you cancle one then turn around and file another one.

It doesn't "look bad" at all. It's not like I filed one the next day.

Well sounds like it was around a years time or there abouts. To some people that may look bad. You wanted thoughts and experience and yet you get all defensive....geeze.

You'll be fine. You'll need to file a waiver form. Look at the I-129F instructions for what to do. It is just a simple letter.

The granting of the waiver is generally routine and should not delay your case at all. They allow the waiver for multiple filings - The comment about it "looking bad" is ridiculous.

I did not include the waiver with my original petition so I received a RFE. A week after sending in the waiver I was approved.
