I am finally ready to file to remove conditions but my delay is the IRS transcript information. I called to get a copy of the transcript from 2007 and 2007 showing that we filed jointly for those 2 years since marriage.

1st call – they sent a 3 page ‘summary’ but for 2008 only

2nd call – the sent a 7 page ‘copy’ but for 2007 only

I do not want to file with 2 different types of documents from the IRS but I do not know which is correct, should I call back to ask for the 3 page ‘summary’ for 2007 or the 7 page ‘copy’ for 2008? Which one is the transcript?

Also, if I send a copy of the 1040 from turbo tax and copies of our W2s for the 2 years, do I still need the information from the IRS?

Otherwise, I have the following in my package. My package is much smaller than those mentioned in other posts that I have read. Do I need anything else:

1. $545 check for I-751 Petition fee and biometrics fee

2. Completed and signed Form I-751

3. Attachment to I-751 for Part 3, item 9 listing additional residences since obtaining conditional resident status

4. Copy Homeland Security/USCIS I-751 reminder letter

5. Copy of Permanent Resident Card, front and back

6. Copy of Marriage Certificate

7. Copy of driver’s license and change of address card issues by Maryland Department of Motor Vehicles for permanent resident and spouse

8. Proof change of address filed with USCIS:

a. AR-11 Confirmation for PR

b. Form I-865 for USC

9. Three original copies of sworn affidavits by U.S Citizen friends

a. friend and former landlord attesting to marriage and that we lived in his condo rent free

b. coworker

c. friend

10. Employer Benefits summary information listing spouse as life insurance beneficiary

a. PR

b. USC spouse

11. Copy of statements from Federal Credit Union showing joint account ownership

a. June and December 2007

b. June and December 2008

c. April 2009

12. Proof of joint home ownership

a. Copy of deed

b. Copy of mortgage statements from Countrywide

c. Copy of County property tax bill

d. Copy of water bill

e. Copy of insurance policy(car and homeowner insurance are with the same company, the letter submitted shows information fro both car and home coverage)

13. Proof of joint car ownership

a. Copy of joint car loan approval letter showing car loan filed together

b. Copy of insurance policy (car and homeowner insurance are with the same company, the letter submitted shows information fro both car and home coverage)

14. Copies of 2 actual credit cards with same account number but different name for self and spouse; cards issued by Capital One and Credit Union

15. Boarding passes from one of the vacations taken together

16. Pictures of us since marriage

Your evidence looks fine! In my opinion you are fine with the two different tax forms from the IRS. This is not AOS where there are specific guidelines to submit financial information. With Removing Conditions we are only showing the joint living arrangements, and that it is a valid marriage. So anything showing that you filed taxes jointly 2007 and 2008 will serve the purpose. They seem to love getting W2s so if you want, send in the 1040 copies with the W2s also. It will show that your paystubs come to the same address too. We're sending in both the IRS tax transcripts and 1040 copies with the W2s.

By the way, I don't know what your "summary" or "copy" from the IRS is. The free transcripts I got from the IRS say, "Tax Return Transcript" on them, two pages each. :yes:

Thanks guys, I called back and spoke to yet another person requesting the "Tax Return Transcript" for 2008 so now they are to fax that to me. They said it can take up to 48 hours for me to get the fax and it's already been 17 hours and the fax has not come through yet. Leave it to them to need 48 hours to send a fax!

Hopefully I will have the transcript for both 2007 and 2008 and will send that with my paperwork. I hope to get my package in the mail by this weekend.

ELW: I was not clear on what they meant but I asked for "Tax Return Transcript" both times but it seems that I got the ‘Account Summary’ the 1st time I called then the ‘Tax Return Transcript’ the 2nd time; I was not sure what the difference was but the 3rd time was the charm and I have what I need now.

CanAmCharlotte: Since you used a CPA I think it’s different from those who file electronically without any professional services; just trying to cover all my bases just in case.

I don't know who sends these transcripts but they seem to often get it wrong! When I was doing the I-134 in 2007 I requested tax transcripts for 2005/2006, The transcripts were the correct ones but for the current date they clearly wrote a different month and year 1994. :blink:

You have to be specific when you ask the IRS as there are different options. If you want the tax account transcript then ask for the tax account transcript. Don't just ask for 'my taxes for the last 3 years' as that is ambiguous. You could always go to the IRS office in person and they will do it in 5 minutes,
