Help! My husband on E1 Visa got laid off before filing AOS

Please help if you have any insight on this, I am in a panic! :(

My husband and I got married two weeks ago. Here has been here on an E1 Visa for over two years and it is (or it was) valid through 2011. We started filling out all the forms for AOS when he unexpectedly got laid off a few days ago. We should have everything ready and in order to file within the next day or two (just waiting on the completed I-693), but it's my understanding that now he is here illegally b/c he is no longer working under the terms of his Visa. Does anyone know if USCIS will overlook this or if this is going to be a cause for denial? Any info is helpful. Thanks!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thanks for your reply! Why the need for a co sponsor? My concern is that he is currently out of status, not my ability to support him. My income is more than sufficient for the income guidelines. Thanks!

USCIS will overlook it. Just send in your AOS application as planned. Once it is pending, his status will be "pending AOS" and everything will be fine. You don't need a co-sponsor if you meet the poverty guidelines on your own. And good luck with everything!

12/14/2006--- Mailed EAD App.

01/20/2007--- Biometrics

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.
