Interview and return of AP

Timeline

A friend has just had her interview, she was here on a tourist visa and then was married in October. At the interview they said she needed her to return the 2 AP documents before they could proceed with the Green card.

Anyone else ever have this happen?

Feb. 27 2008 Petition mailed to VSC via USPS

Mar 3 Delivered VSC

Mar 28 2008 2nd Petition mailed to VSC via USPS first one must be lost.

Mar 31 2008 VSC Received.

Apr 9 Check Cleared.

Apr 9 NOA1

Apr 13 Touched.

Apr 14 Touched.

May 6 Touched

May 7 Touched

July 14 NOA2 (4 months 2 weeks 3 days after it was sent)

July 16 Received NVC.

July 18 Shipped NVC

July 21 DHL Received.

July 23 Delivered Kiev Embassy.

Aug 1 In embassy system, assume they sent packet, can schedule interview.

Aug 4 Schedule interview earliest date is Sept 22.

Sep 22 Interview Date (Approved)

Sep 25 Visa arrives in mail.

Oct 6 Alyona Arrives Dallas.

Nov 28 Married!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!1

Total days waiting for our future, 7 months 1 week 3 days.

Dec 16,2008 AOS Sent Fedx to Chicago

Dec 17,2008 AOS Recieved.

Dec 22,2008 NOA2 Date

Dec 23,2008 Check Cashed.

Dec 26,2008 NOA2's arive in mail.

Dec 31,2008 Biometric arives in mail.

Jan 14,2009 Biometric Appointment.

Apr 10, 2009 Interview

Apr 20,2009 Conditional green card production ordered.

Apr 28,2009 Green card arrived.

with an approved greencard the AP document is null and void so it really should be a non issue

It is an issue because she was planning on traveling the week after her interview and hence does not have a green card yet. My wife did the exact same thing, interview on a Friday, return to visit family in Ukraine on the next Wednesday.

Ask/Tell them to put the I-551 stamp in the passport. Problem solved.

I am still curious about why they needed the other docs back. Is there some concern about fraudulent use of same?

I am still curious about why they needed the other docs back. Is there some concern about fraudulent use of same?

Hmmm.... I guess that makes sense, except why would you use an AP to travel when you had a greencard already (especially if you knew it was void)? And what about when the AP and GC are both mailed to the petitioner? If I am reading other post correctly here, there are lots of GC holders that get their AP about the same time.

And what about when the AP and GC are both mailed to the petitioner? If I am reading other post correctly here, there are lots of GC holders that get their AP about the same time.

You assume that all applicants have the same level of intelligence that you have. There is a period where your GC is approved and you should use the I-551 stamp to travel instead if you don't have your card yet. AP may give the intellectually challenged the idea that they can travel without their GC yet after being approved.

Oh and may I add it does say on the interview checklist to bring every immigration document issued to you.

First no I551 stamp was issued.

2nd even after the green card is approved, the AP document would still be enough to get you back into the states. This exactly what my wife did with no problem.

So for the original question, it appears no one has had this happen.
