B1 while K1 is pending

Timeline

Hello all, I'm new to the site.

I sent in the I-129f to the CSC a few days ago. My fiancee is a dentist in her home country and needs to take the American Dental

Board exams. To take these exams she needs a B1 visa. So would it be possible for her to apply for a B1 visa while the K1 visa is pending?

Our intent is not to get her here on a B1 and get married while she's here on that visa. But she really needs to take these exams so that

she can apply to dental programs here within the year.

So, are you allowed to apply for 2 visas at one time? And would applying for the B1 cause any problems for her K1? Should we just wait until

the K1 is approved even if that means that she'll have to wait another year to get into a Dental program here?

I don't believe that the B1 will interfere with the K1 at all (though the reverse may be true), even if your fiancee is turned away at PoE.

I think you'll have less hassle if you just wait for the K1. I don't think it will hurt to try for a B1, but may end up being a waste of money.

I agree with the previous poster, theres no harm in trying but it may be a waste of money.

If she did get the B1 bringing along a document of some kind verifying that she was coming to take the exams and then of course ties to home would help her get through the POE.

Wow! Coming for a dentistry exam? No brainier I would think :D If your fiancee has strong credentials that would indicate the ability to pass this exam, I would expect the B-1 would easily be approved :D There it a very high demand and want in this country for highly educated professional, especially in the medical fields! This one should be easy!!!

As per K-1 petition, unless specifically asked, there is no reason to volunteer this information. Chances are very low it would even come up, I suspect. And if it does, it can easily be used as an argument of further evidence of no intent to illegally overstay. After all, if s/he passes the exam, s/he would easily qualify for an H1B visa anyway, with which s/he could easily enter the US and then you could marry and adjust status with few questions asked. :D

As for POE, about ZERO chance it would come up. Border officers don't have information on K-1 petitions on their screens by default. There is no reason to mention it, it is irrelevant to the purpose of the trip. Don't worry about it! :D Go for it :D
