Hi,

Getting package ready to send tomorrow, and we do not have our 2008 tax return transcript as I keep calling, and its not ready. However we did get our refund check yesterday which makes me think it has now been processed. Should I wait the extra weeks for the transcript to come, or just include a copy of the retunr that we mailed in, with the refund check with I think proves that we did send it?

Also, in the tax return there are a few pages for the apartment that my husband owned before we were married. We tried to rent it (co-op board wont allow it) and tried to sell it (market in NY is tough right now) and so it sits empty. I kind of want to take those pages out of the tax return, and I think it looks weird ' oh, he has a seperate apartment that he keeps empty'... but I guess I should put it in right? Would you put a note to explain it, or just leave it? We have since bought a new apartment together and I am including all the mortgage info, and bills/mail to us here, so I think it proves we do live here...

Any tips would be so helpful. sending it off tomorrow....

Also- We are trying to sell the apartment that my husband ownes that sits empty. Should I print out the apartment on the real estate brokers webpage to show that it really has been for sale for 5 months? And then put a note saying that we are trying to sell it?

a tax return is not considered complete unless it also includes all schedules and attachments. Don't worry about explaining items unless you are below the threshold on Line 22 of the 1040.

In any of my submissions, I never included proof of filing (such as a refund check) so I do not think that is such a big deal... do so if you wish.

If you do not send your 2008 transcript, send a signed copy of your 1040 with copies of your W2. You do not need to include all of the schedules, so you would not have to include all the info about the apartment.

i filed taxes in turbo tax, i printed it out and sent it with my i-751 application but i did not signed it thats 2007 and 2008 itr, will that work or not?, i sent a 2007 transcripts though for both my husband and i, we filed separetely, oh man now i'm wondering if i'll get an rfe.

No - incorrect - If you file electronically there is no signature! I always submitted copies of my tax returns that I printed off Turbo tax etc. - always submitted unsigned copies - you do not need transcripts.

Also I only submitted the 1040 and schedule A and - nothing more - - In my opinion you can skip all the other schedules unless they have a lot of income or expenses being reported - I always skipped the foreign income exclusion forms, schedule D forms, Schedule C etc. etc. - they had small amounts of income and expenses and I never included them. The main tax form is the 1040 - rest of it is schedules that bring income or expenses or exclusions to this form - so if your main income is from wages the rest of the forms are quite superfluous for immigration purposes.

My opinion is based on 20+ years as a tax administrator and on how I did all the paper work for my wife's visas and citizenship; but you should do what makes you comfortable. Good Luck

Timeline

Just submit a complete copy of what you filed, even if it is not signed. That will suffice. There is no reason to wait for a transcript. As to the portion you would rather omit -- don't. No one really looks at all that stuff, just the bottom line and also to see if the complete return was filed. If there are missing documents, you'll be asked for them.

NO need to send SIGNED copies of 1040s

thanks, I was afraid I would have had to contact the USCIS and send back my wife's greencard because I did not sign the return.. :)
