my friend who is an illegal alien here

hi, just wanna ask advice and this is for my hispanic friend who's been here in US fro 10 years just by crossing the boarder (sneaking). She got married with a USC and got a 2 children now but she was never petition to become a legal resident. They parted ways with her ex-husband and now she found someone who truly care for her and willing to marry her and file for petition. He's a USC but he doesn't know what paper they need to file for her since she's undocumented. He can't afford to hire a lawyer too. Can anyone tell me what's best for them to do in order to get her fiance legalized here? She doesn't wanna go back to Mexico coz her 2 kids were studying here. I would highly appreciate your input about this matter.

Timeline:

2-02-08: Honey arrived in Manila

2-04-08: travel down to my hometown, Zamboanga

2-07-08: Our Engagement day

2-27-08: 1129F sent to CSC

2-29-08: NOA1

3-02-08: first touch

7-11-08: 2nd touch- APPROVED!!!!

7-14-08: received email from CRIS that our petition has been approved July 11'08

7-16-08: received hardcopy of NOA2 in our mailbox

7-23-08 hard copy from NVC

7-28-08 paid delbros for DV

8-19-08 medical (LORD, pls. keep me physically fit)

8-27-08 Interview, got pink slip, praise God

9-05-08 received my visa, had my CFO the same day

9-06-08 flight to US, POE LAX

11-08-08 wedding day

11-12-08 ssn application under my husband's name

02-26-09 sent AOS packet to Chicago Lockbox thru USPS Express

02-27-09 recieved & signed by V.Bustamante

03-05-09 cashed check

03-09-09 AOS, EAD, AP received

03-12-09 Biometrics appointment notice recieved

03-28-09 sked for boimetrics, 2pm,done

04-13-09 received letter for initial interview sked 05-13-09

04-23-09 AP received

04-27-09 EAD received

05-13-09 passed GC interview, my status online says GC production ordered

05-19-09 Welcome letter received

06-24-09 Green Card receive

02-13-11 Lifting of Condition

02-09-11 ROC package sent

02-18-11 recieved NOA, waiting game

She can never adjust her status because she is undocumented (sneaked over). She will have to go back and DHS is going to put a 10 yr ban on her. It doesnt matter if she gets married again, her sneaking across the border has dealt her a bad hand, children or no children, sorry.

Kcoyclay1 is correct, she cannot stay in the US if she wants to become legal. Coming to the US illegally has hindered her ability to become a legal resident presently. She must return to Mexico and wait out her inevitable ban. If your friend wants to continue to the process he may file for a K-1 visa which will be denied at the interview. Once it is denied the USC will file the I-601 which he will need to show how if his fiancee is not returned to the US he will undergo extreme hardship.

Its hard for me to feel any sympathy for this person, nor would i come to a forum where everyone thats a member has had to wait countless months and pay untold amounts of money to get this immigration process done right. The woman should have thought of the consequences before coming into this country illegally. If these 2 people truly want to marry legally , have the man move to mexico and marry her there. then wait out the 10 years, then apply again. Sorry if this explanation hurts your feelings. These are the laws, and everyone has to wait and go through the process. Tell your friend she will get no pity here for her situation.

If your friends wants to stay in the US she will have 2 stay undocumented for rest of her life or go back to Mexico and wait out the 10 year ban and then apply for legal residence from Mexico - tough choice
