Ok I've like read this entire forum now (well since it crashed). I am getting the understanding that you need to be is it 125% above the poverty line or else you need a sponcer. My fiance is below the poverty line despite not having any problems paying his bills. We haven't got to the stage yet but when they find out this (I assume theres money questions after NOA2) will they delay us, then send a letter saying we need a sponcer or will the next lot of forms have the option to fill in sponcer information. Really don't want to be delayed yet again. How does it work?

One of the documents the USC will need to send for the K-1 visa interview is an I-134 for the affidavit of support. If you are already aware that the poverty level isn't met, then it would be advisable to send the co-sponsor form at the same time to present at the interview.

However, it is my understanding that at the K-1 visa level, only 100% above poverty level for the I-134 is required for UK applicants, so if the USC is above that, then the K-1 visa should be approved (assuming all other criteria is met) based on only that income. It probably wouldn't be a bad idea to submit the co-sponsor's affidavit for that interview, though, just to be safe. Of course, if the income isn't above the 100% poverty level, then a co-sponsor would be required, even at the K-1 visa interview.

Once you are married, it is the I-864 affidavit of support that will definitely require 125% above poverty level so the co-sponsor affidavit would accompany the AOS package at that time or you would undoubtedly receive an RFE.

You will need and I-134 at your interview. You will hand carry it that day.

The 100% requirement isn't just London. It's the technical requirement in all countries but NOT ADVISABLE based on anecdotal evidence in this forum.

I believe you should ALWAYS work with the 125% no matter what country the fiance is from, based upon that is what you will need when you are going for your AOS after marriage.

Without offending, Fiona, it is also relevant to your case as to where the money is coming from. If Andrew's income is mostly from SSI, you may need a co-sponsor, even if he met the guidelines. I don't know if SSI is considered a 'means tested' benefit. I think it may be but I really don't want to scare you or make you think you won't get your visa.

The government wants some sort of promise that the beneficiary won't end up on public assistance.

I'm not easily offended so don't worry lol. We figured we would need a co-sponcer anyway you're right because of our situation and knowing it isn't going to change. His mom would more than likely be the co-sponcer as she will be in the same household and Andrew and her swap money back and forth as needed. She actually just recently got some tax returns and bought him a new computer.

My worry is if we don't get a co-sponcer form way before the interview so everybodys aware whats going to happen we may get turned back at the interview for not having it already sorted. If the forms to do with this sort of thing are forms taken on the interview instead of posted back and looked over a bit before we get an interview date because it may seem to have suddenly come to there attention we'd get turned away till its sorted? It'd kill us to make 2 trips to London because I live in North-West england. Just want to avoid as much "fuss" as possible. Whats after NOA2, Packet 3?

AFAIK, London evaluates the affidavit of support at the time of the interview for K-1. You don't have to send the affidavit of support in before the interview. Whether or not they find the affidavit of support sufficient is determined at the interview. After NOA2 and packet 3, there is the medical, vacination and visa photographs that need to be done.

Fiona, take Andrew's I-134 and also his mothers I-134 with you to the interview.

Produce Andrew's first. If it is not sufficent you will have his mothers on hand, hence avoiding that dreaded second trip to the consulate.

That is what I did. They were happy with mine alone. However, for AOS, I have included my co-sponsors affidavit.

When you receive Packet 3, it will tell you to go ahead and schedule your medical. Your interview date won't be granted until you have returned all the docs, INCLUDING THE CHECKLIST, back to the consulate.

You need to take your medical results with you to the consulate when you go to the interview, if they aren't mailed directly from Knightsbridge to the consulate.

You will need a second set (2) full face passport style photos also for the interview, your long form birth certificate, and your police report.
