A second Interview for adjusting status

I suppose this may be viewed as good news. But it is freaking me out a bit. We got a letter today that states that we have to go in for a second interview for the AOS in June. The letter asks us what is required for us to bring, and mind you we have given all of that at the first interview last month. At the bottom of the letter it is written in bold that : THIS INTERVIEW MAY BE VIDEOTAPED. Could this mean Stokes?

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Did something go wrong in the 1st interview ............. as i saw in your timeline you said "The CO could not make a decision on our case as background checks were not completed at the time of the interview." that FBI namecheck. But they do not call for a 2nd interview in that case. Can`t say for sure this is Stokes or not. I hope we will get some more experienced views on this .....

April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card

If the interview letter is addressed to the petitioner then it's most likely a stokes interview, but if the letter is addressed to the beneficiary then it could simply be a follow up interview. And what form did you receive for the interview? If it is I-797C then the interview was scheduled by NBC. If it is another form (like G-56) then the interview was scheduled your local office. The statement "The interview will be taped" itself does not mean that it is a stokes interview.

Me too. I thought everything went good at the first interview. Who knows what THEY thought. We brought a lot of proofs that they didn't want to see, saying, " We have enough already ". What may be bothering them is that I did not change my last name, and at the interview we handed them the I-864a which my husband filled out earlier that week. We had our tax returns, a letter from his employer, his W2, phone, gas and electric bills which the most recent were not included when we filed back in September 2008 and handed them over. Everything else required was provided in our application.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Thank you for your reply. The letter has both of our names on it and it came from our local office. It has nothing that says I-797C. Under our name and address before the please come to the office below it has CC:

I did not change my last name either, and we had not even been asked a thing about this (done interview at Chicago DO). Good luck in June!

11/17/08 : Application sent (I-130, I-131, I-485, I-765)

11/18/08 : Official receipt of documents stated on I-797C (Signature for receipt at USCIS was on 11/17/2008 at 10PM)

11/28/08 : NOA Received ( I-797C) for all 4 forms (forms issued on 11/26/2008)

12/18/2008: LUD on I-130, I-131, I-765

01/29/2009: Bio done

01/29, 30/2009: LUD on I485 and I765

2/10/2009: issued AP, valid 1 year for multiple entries.

2/23/2009: Got EAD card

3/8/2009: LUD on all applications. Shows approval of I131 and I765, still pending on I130, I485.

04/28/2009 at 9:30 AM: Interview. Told to wait 90 days for a resolution by mail.

05/01/2009: Card production ordered.

05/06/2009: Received approval NOAs for I130 and I485 (welcome notice, 10 years card). I130 still shows case received and pending.

06/18/2009: got the 10 years validity card. Process length: 213 days since sending the applications.

No RFE at all along the process.

Nagi, I'm sorry they are putting you guys thru another AOS interview.

Gary and i had 2 as well. Our letter said the samething as yours, about the videotaping, which they didnt do. The AO just asked us a few more questions, and we submitted more proofs of our relationship. Unfortunately we werent given an approval or denial at the interview :angry: Then 4 weeks later Gary received the email from CRIS that he was approved.

This sounds like stokes to me seeing that it is a second interview but as Garyandmarylou stated they got a second interview and it wasn't. When I sat waiting to be interviewed by the IO I overheard a lawyer telling his clients that if they got a second interview it means it is a stokes interview where they separate the spouses and question them individually.

My advice is to go over the questions asked in a stokes interview. Take all that they require and be relaxed and calm. Don't discuss any fears if the IO leaves the room. If your spouse do not know the answer to a question don't guess, just say I do not know. Know birth-dates, siblings names, favorite color and favorite food, who does the cooking, which side of bed you sleep on ( and know if you are answering based on facing the bed or laying down cause that changes what is left and what is right). Know each other number at work etc. I know you understand what I am getting at but be prepared for stokes just in case.

When you get to the interview be your normal selves. Joke around while waiting or just talk about something of interest but never go over the questions you think you will be asked. Again I know that you know all of this but....

This is an interview review I read.

Hello,

I would like to share my I-485 interview based on marriage to USC.

Little bit info about my case, i filled i-130 about 2 yrs ago but USCIS officer made some mistake, mixing up my document with someone else`s, there was no result for almost 2 yrs so... i re-do everything again, I130 and I485 together on november 28th 2008.

My appointment was yesterday, march 19th 2009 1pm at Garden City, NY

We were living together for 7 years, married for more than 2 yrs and we have our 18 months old baby comes with us.

The lady officer was a mid-age Phillipinos, was nice at the beginning, very talkative but she could switch to a mean person in just a second.

Here is the document that she requested:

1. My passport

2. Any letter from USCIS (i had a granted witholding removal on assylum case before i was married to USC husband)

3. Any joint documents (we had IRS-Tax doc, checking account, credit card account and insurance)

4. Our daughter birth-certificate

The question she asked,

How did you met?.... Do you come from the same country?....How long have you been married?.... How many people come to your wedding?.... have you meet each others parents?....Is there any Indonesian community here in NY?..... When was the last time you visited your country?..... and how was it?.... How did you come to US?

Then she wants to see our photo album and make some nice comments about it, she said that my case is approvable, she would review my assylum case before making decision, then i asked her how long does it take? and she suddenly mad, she said "Don`t push me!" and i was like, "No, i was just asking question" then she said, "I don`t know, only God knows!" (then i found out later on the paper that it would take 60 days)

Then here she become nice again, she said, "if i need more documentation i will send you a letter and if it`s quite then you will receive your green card through mail." Then of course i choose not to say anything anymore, when she walk me out... again she became mean again she said once again, "You came here with tourist visa and overstayed, now you are LUCKY you`re married to US Citizen!!" while pointing to my husband.... and then she said, "well... maybe you will get your assylum case granted... who knows." (how can i get my assylum re-open?? if i dont re-open... and i have i485 pending? To me it`s a very silly statement)

Oh, also... she wrote my A#, IR6, Sec.245 pending and her name on my passport.

Does anybody have experience with sec.245?

Do you mean I-864? or are you using a co-sponsor?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

No we included my husbands income as a household member, something we did not do and could not do at the time we filed for the AOS ( he just started working and the job was ' iffy' at first plus we didnt know his income could be included ).

My sincere thanks to everyone who has responded in this thread! We will prepare what is necessary and grill each other until we are breathing and eating every question imaginable....and of course pray for good results.

Thank you, uscan!! I have got such positive responses here, and it is as if everyone knew I was feeling a bit down after getting this letter. I really do needlessly worry. But worry is good. It keeps me is check.
