waiting on b1 b2 visa in america for cr1 interview

hello i am just wondering is it possible for my wife (who i already applied for cr 1 for) to visit on tourist visa and wait with me in the US to get her interview (for cr1) then go back and do the interview? then come back on cr1? how long does a tourist visa last? and can an indian get it? and if so how long does it take to get it? and what is the chance of it being approved? is there any chance this will raise any red flags for us? thank u all

interview date- 11/06/2009

visa approved! 11/17/2009.. pheww!!

received passport-11/20/2009

entered in US- 12/14/2009

POE- New york

welcome received- 02/01/2010

green card received- 02/08/2010

removal of condition-12/15/2011

ROC package sent to CSC- 09/21/2011

You can always try to get the visa - but it might be tough.

Tourist visa are usually issued for 10 years, and the visits are 6 months in duration. (depending on the CBP).

I would think, you would have as long a wait for the tourist visa as you will have for the CR-1, plus with the added bonus of spending more money. (which you don't get back if they deny it).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You are not adjusting status from a tourist visa, you have applied for a spousal visa, and are in that process. Moving this to the correct forum.

Bobby_Umit is right. I know one thing for a fact that Pakistan and India fall in a category where getting Tourist visa isn't easy. The scrutiny is more harsh than it is for CR1 visa, I assure you. Plus time consuming. If she is coming for the first time, it will take you close to 4-6 months to get the visitor visa, whereas for frequent travelers it take from 1-2 months, depending on your embassy/consulate. Also, if she has already applied for CR1, she has shown her intent to reside in the US. Not much chance of getting a visa, unless she has Extremely strong financial/family ties back home in India.

sorry if yr wife is indian citizen and u r USC and u hv applied for ir-1 visa or c r-1 then u cant get another visa.. not even tourist visa as yr one file is in process.. it may give wrong signal to visa centre if you get tourist visa before ir-1 .. in this matter u can meet any visa consultant for further inquiry. or check the FAQ of VJ
