The petition approval doesn't matter except if you don't apply for a visa within 4 months of that date. What's important now is the expiration date of the VISA. It's printed under the birth date and should be 6 months from when the visa was issued. It must be used to enter the US before that date. Are you planning on delaying his entry past February?

*SIGH!*

Yeah, all of this has been extremely frustrating...to the say the LEAST. It will be a year since I filed the I-129F tomorrow :( . And...my fiance's UK student visa is set to expire on November 30, 09. And we are NOT going through the process to get it renewed....#1) Because he no longer will be eligible for an extension and #2)We are not going to go through another hell of a process to get him eligible for an extension and then actually go through with the process of an extension...our nightmare earlier this year was more than enough to deal with.

So I don't know what is going to happen...we are still waiting on the 2nd congressional inquiry results...I called DOS today it is still in AP/AR. It has been 97 days since the interview itself and 63 days since the embassy logged his passport into he system. Of course we don't know how much longer this is all going to take, but if it does end up going into November we may have to deal with the issue of transferring his processing over to Islamabad, Pakistan...I don't even know if that is possible because the DOS reps offer b.s. every single time I ask them anything. The embassy has not been replying to our emails requesting processing updates...don't know why even though the automated email says that if processing is less than 90 days they won't reply and it has clearly been longer than 90 days...

We are just waiting for the good news everyday...and come October and we don't hear anything new, then we will have to pursue other ways, whatever we can do to ensure for us to never to be apart like this ever, ever again.

  • 2 weeks later...

Just a quick update about us:

We have made 4 senatorial/congressional inquiries during the past few months as well as contacted the embassy on our own via postal mail, emails, phone. London finally seems to be replying to emails within the time frame they say they do "three to four days average...". I believe that they had slowed down significantly in processing in the past couple of months. Currently, my fiance is in administrative processing: specifically the regular AP that everyone goes through. He is no longer in review, i.e they are done with verifying his qualifications for the visa and these are security checks now. So once additional documents have been submitted and eligibility for the visa has been determined, the last step is security checks (don't know how long they will take of course). We have informed the embassy that my fiance's UK residency will expire in Nov 2009 so that they know that we are on a time crunch--don't know whether they care or not--probably not, but it was important for them to know that he plans on NOT extending his residency in the UK.

What irritates me very much is the fact that they sat on his case for more than two months and then decided to "verify his qualifications for the visa". They could have just called me the day after his interview to do the phone investigation that took them 76 days after the interview to do. And the whole time we thought that they were completing his standard security/background checks...when actually his file was just SITTING there. After they cleared him for the visa, then they put him in security/background checks...which he is under at the moment.

I hope this is all over soon so that we can continue with our life...
