Visiting the USA while awaiting NOA2

Hi,

Is it possible to visit the USA on the VWP while awaiting the NOA2? I know this question gets asked alot however has anyone done it lately?

The proof to tie me to my home country includes a car loan, bank accounts, employment. Is this enough?

K1 Visa

01/22/09 - NOA 1

05/14/09 - NOA 2

06/30/09 - Interview

09/13/09 - US Entry

AOS

09/22/09 - Married

10/09/09 - Filled for AOS

25/01/10 - Green Card Approved!!!

I would not worry to much! The border officers don't seem to have any idea that you have a petition unless you tell them, from all reports I've heard (including from my fiancee who visited after we posted in Feb and is due to visit again soon :) )

Just expect a normal interview. You (or your SO) is coming here for a visit on holiday. No need to say more unless asked. Don't lie. But, don't offer any un-solicited information either. Smile, be relaxed and assured. It's just another typical visit. :)

There are no rules or regs or anything against or even mentioning visits by fiancee's, whether in a petition process or not. Heck, if it comes up, s/he could use it as an argument AGAINST possible indication to overstay, since such action would kill the visa application!! :o:D

You (and him/her) will do fine :)

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)

the K-1 does have an intent of staying, Customs and Border Protection(CBP) may or may not know, if asked just be honest, your employer letter should suffice to get you through immigration, but be prepared to be turned away if have too, this has happen to some people...

You shouldn't have any real problems at all as the VWP and your application are not connected.

Just be honest at border control. If it's for a holiday with your SO, then tell them you are taking a holiday. You don't need to go into fantastic detail with them.

If you do have some worries about being denied for any reason, it could be handy for you to have a letter from your employer, lease agreement or some other piece of evidence to show you will be returning home.

I was quizzed a little bit more than usual last year, but my employment status was more than enough to keep me from having to stay behind.

I went twice while waiting for the NO2, three months from September until December 2008 and two months from March until May 2009. No particular questions at the border. Three weeks ago we went to Canada for a week vacation and coming back into the US no questions at all!

A week after I arrived in the US we were approved and I'll have the interview on June 8th.

Time line K1 visa:

I129F package send: May 28th, 2008

NOA1 received: June 5th, 2008

NOA2 approval: March 25th 2009

Medical exam: May 26th 2009

Interview: June 8th 2009

Visa received :June 11th June 2009

FYI, folks, B-1 is a "visit for Business" visa, not pleasure. Business is NOT permitted under the VWP nor a B-2 visa and would therefore be an immigration violation. Hence the OP's question.

Business related visa's are MUCH easier to get than most other kinds, if you can show the right credentials.

While a K-1 visa DOES indicate an intent to EVENTUALLY come and stay, it can also be used a to argue evidence that one would not want to violate the terms of any visitor visa, since that would invalidate the K-1 process.

But, as I said, why even mention the K-1 petition? It is irrelevant to the purpose of the B-1!
