Hi guys, finally I got all the information from my friend now. I'm sorry I was not specific on my forum about the denied visa. Cuz at that time, my friend just told me that his wife was denied because of insufficient income and that's the only reason. He was so depressed that's why I didn't ask him again. And so I posted here and asked some advice to all of you. After reading the replies here, I tried to get in touch with him and asked the whole story about it. He said that the consul just gave his wife a white slip only. No pink slip at all for AIR21 visa delivery. The consul said " I can't give you your visa yet, you have to submit additional affidavit of support that shows your husband can support you in US." After that the consul gave her a white slip for the affidavit of support and was schedule to submit it next week. In my opinion, She doesn't need to have another interview. All she needs to do is submit what the consul asked for. Am I right? And obviously, she will be under administrative review.

One more question, She's not deny.....right? Only under AR?

She is under AR. They need to submit those required documents before the deadline. Besides the affidavit of support, if his husband could give other documents such as payslip, letter from his employer showing his present salary, bank statement, investments, mortgages it would make their case stronger.

Not denied. Happened to one of my friend. Her USC husband doesnt have sufficient income so they got a co-sponsor in the US, you know, same procedure, mailed the affidavit of support and tax papers (evidence about the co-sponsor's income). My friend wasnt called for another interview. I think, if im not mistaken, she just was notified via mail to appear in the US embassy to a certain window and pay for the visa delivery and thats it. She got her visa couple of weeks after that.

March '05 - met George online thru common friend

March '06 - He went to visit me in the PI first time

May '06 - He came back for the family reunion and proposed for marriage

Nov. '06 - came back to prepare for our wedding

Dec 16, '06 - Wedding Day!

took at least 6 or 7 months (as i remember) for the K3 and was approved!

Nov '07 - I arrived in the US

together again with my gwapo, lol

April 9 - mailed in AOS package

April 13 - NOA for EAD and AOS

April 22 - Biometrics Appointment and will be on May 7 in Jamaica

May 7 - Biometrics done!

May 14 - Got an RFE dated may 9 - joint sponsor :-(

June 5 - they received our reply to the RFE

June 10 - EAD card production ordered, YAYYYYY Thank u, God!

June 21 - EAD card received in mail.

...and the waiting continues for the interview date...... will update later

so i got my interview date, and guess when??

Sept 10 - yaayyyy and its my hubby's Birthday! Approval would be a GREAT bday gift.

Sept 10 - got APPROVED! Indeed its a GREAT Birthday gift! " Card production Ordered" Yayyy

Sept 18 - Welcome Letter received!

Sept 19 - Green Card in hand!

K-3 IS an immigrant visa.

That is not quite true. According to the State Department, a K-3 is a Nonimmigrant Visa for a Spouse.

Here is some of what the site says about the K-3

Spouses of U.S. citizens, and the spouse's children, can come to the United States on nonimmigrant visas (K-3 and K-4) and wait in the United States to complete the immigration process. Before a K-4 visa can be issued to a child, the parent must have a K-3 visa or be in K-3 status.

The spouse of an U.S. citizen applying for a nonimmigrant visa (K-3 applicant) must have an immigrant visa petition on his/her behalf by the U.S. citizen spouse. Therefore, the spouse of the U.S. citizen (the K-3 applicant) must meet some of the requirements of an immigrant visa.
